RECOGNIZING THE 40th ANNIVERSARY OF CITY OF BELOIT GRINNELL HALL SENIOR CENTER
WHEREAS, Grinnell Hall Senior Center opened on September 9, 1977 with a mission to develop and maintain a diversified program of services which meets the recreational and leisure needs of the older person in the community WHEREAS, Grinnell Hall is celebrating its 40th anniversary in 2017; and WHEREAS, there are currently more than 450 members ranging in age from 50 years old to 95 years old with fifty six percent being 70 to 84 years of age. WHEREAS, Grinnell partners with over 34 organizations in Rock County; and WHEREAS Grinnell works each year with AARP to prepare over 350 tax returns for residents at no cost. WHEREAS Grinnell staff is in charge of the Beloit Senior Fair Committee, which is celebrating its 30th year in 2017. Over 60 vendors and over 600 seniors attend this expo each year. WHEREAS Grinnell’s lunch program served over 5,000 lunches last year WHEREAS, Grinnell volunteers donated over 14,000 volunteer hours last year WHEREAS, Grinnell Programs had an attendance of over 26,000 in 2016 NOW, THEREFORE, BE IT PROCLAIMED THAT the City Council of the City of Beloit recognizes the 40th anniversary of Grinnell Hall Senior Center and honors the staff and volunteers who contribute to the success of Grinnell. PUBLIC COMMENTS Yuri Rashkin, 629 Park Avenue, introduced himself as an interested resident seeking appointment to the Beloit City Council. He teaches public speaking and works at UW-Whitewater and UW-Rock County. He was born in Moscow Russia and has been a US Citizen since 1988. Community involvement is crucial to him. City Council plays an important role in finances and economic development and he understands that citizens deserve a responsive government. Allen “Butch” Dix, 2434 Stonehedge Lane, Beloit (Turtle Creek South) has lived in Beloit for 79.5 years. He is requesting a signal at Cobblestone and Cranston as well as a 35mph reduction in speed limit to 30mph from Shopiere Road to the WalMart store. He presented to the council a petition from residents in the area supporting this request. He also attached a Beloit Police Report showing the numerous accidents due to speed (128 accidents recorded in the area he is referencing according to a police report he requested.) President Leavy referred the item to the Traffic Review Committee and asked for a report back to Council. Matt Finnegan, 2212 Knoll View Drive, Beloit. He came to discuss the Proposed Ordinance on the agenda tonight for a second reading. The Beloit Property Managers Association is hoping that the City might put something else in place better using the resources that we have. In 1994, the Association was a driving force to getting the inspection program put into place. The reality is that they realize this wasn’t going away but 23 years ago Beloit was different and required a shotgun effect to deal with problem landlords. He believes this ordinance continues a shotgun approach instead of lasering in on habitually problematic landlords. He urged the council to lay this ordinance over so it can be looked at

more and review fee structures. He thinks that the City and the Association have the same goals. He thinks that there are a lot of fragile home owners in Beloit and maybe the staff could help them pursue resources to get a new roof instead of this approach. Prisha Gustina, 1313 11th Street, Beloit is a lifelong resident of Beloit, as well as a retired teacher. Her family owns many properties and she said she is passionate about Beloit and wants to see continued improvement. She would like the council to lay over the Ordinance on the agenda so there can be more discussion. She is pleading for communication between community members and the City. This Ordinance pertains to their livelihood and they'd like a voice at the table. She is also looking for equality for both the owner occupied and rental properties.

ORDINANCES 8.a City Manager Luther presented a proposed Ordinance to Repeal Section 14.06(6), to Repeal and Recreate Sections 14.06(2), (3) and (4), to Amend Sections 14.02(9), 7.06(2)(c), (d), 7.065, and 25.04(4)(d) of the Code of General Ordinances of the City of Beloit Pertaining to Rental Registration Certificates, Rental Dwelling Unit Inspections, Inspection Fees, and Enforcement of Parking Violations for a second reading. The proposed ordinance provides the required changes to the residential rental program in order to comply with the circuit court

decision as well as offers new options and services that allow the City to address the public health and safety issues that the residents of Beloit have come to expect. Details of the proposed ordinance were reflected in the August 21st minutes when presented for first reading. Councilor Preuschl stated that there was much discussion at the August 23rd housing seminar where there was a variety of businesses, citizens, landlords and city staff present. This is an item that needs to occur as we approach the next budget cycle and he is in support of this ordinance. Councilor Blakeley stated that the two speakers talked about owner occupied being treated equal to rental property standards. City Manager Luther discussed the difference between the potential conditions in which someone running a business who may choose to let someone live in a home that may have issues, compared to owner occupied dwelling. The inspections are for the more difficult properties where compliance has been more difficult to achieve. Councilor Forbeck spoke to Mr. Finnegan’s comments and said she is sure there are good landlords but she also is aware that there are properties where the City needs to pay attention to safety. McBain Enterprises, Inc. has submitted an application for a Zoning Map Amendment to change the zoning district classification from C-3, Community Commercial District, to PUD, Planned Unit Development District, for two portions of the property located at 2956 Milwaukee Road. The Plan Commission reviewed this item on August 9, 2017 and voted unanimously (7-0) to recommend approval of this Zoning Map Amendment. COUNCILOR ACTIVITIES AND UPCOMING EVENTS Councilor Forbeck attended the Housing meeting at the Library and was pleased to see so many people who know things about housing in attendance. She looks forward to continuing the conversation. Councilor Preuschl attended the Peace Walk sponsored by Switch Lanes. He attended the Legislative Breakfast with Reps Sprietzer and Loudenbeck. He attended the re-opening of the Merrill Community Center. He reminded everyone that Discover WI will be back in town to film the farmers market this weekend. He applauded the engineers and crew of the City who fixed State Street last week.

Councilor Anderson attended the Community Action open house. Today he dropped off some food for the children who attend the after school program. He has entered a friendly wager with Janesville Councilor Jorgensen that when Craig High School plays Beloit Memorial in football on September 22nd, that Beloit can collect more food than Janesville. Please consider bringing nonperishable donations that home game at 7 p.m. Councilor Blakeley shared a list of what she did this summer: The Beloit City Parks Tour; The Farmers Market; a ride along with BPD on July 4; Neighborhood Listening sessions; Beloit Together rally and Switch Lanes Peace Walk; the opening of the Blender Cafe; Walking by the river to watch the eclipse. She also pondered on how you make a Beloiter a lifelong community member? She believes this is Beloit's biggest challenge. She wants to change the City's reputation and we need to continue to spread the word about what is making Beloit a great place to live. Vice President Dunkin met with Youth 2 Youth members to learn about ways reduce substance abuse in the community. She ate at the Blender cafe and encouraged others to check it out. She was at the Farmer's Market and stated that it runs through October. President Leavy echoed the Beloit vs Craig rivalry competition and encouraged all to participate.

RESOLUTION APPROVING A 23-LOT FINAL PLAT OF SUBDIVISION CALLED EAGLES RIDGE PLAT NO. 3 FOR THE PROPERTIES LOCATED AT 3650 EAGLES RIDGE DRIVE AND 1510 TOWNHALL ROAD WHEREAS, New Leaf Homes LLC has submitted a 23-lot Final Plat of Subdivision called Eagles Ridge Plat No. 3 for the properties located at 3650 Eagles Ridge Drive and 1510 Townhall Road; and WHEREAS, the Final Plat, which will create 22 residential lots and an out-lot for stormwater management, is located within the corporate limits of the City of Beloit and contains the dedication of land to the City; and WHEREAS, the City of Beloit Plan Commission has reviewed and recommended approval of this Final Plat, subject to three conditions outlined below; and WHEREAS, this Final Plat substantially conforms to the Preliminary Plat, approved by the City of Beloit Plan Commission on August 9, 2017; and WHEREAS, the City Council of the City of Beloit has reviewed the proposed Final Plat of Subdivision called Eagles Ridge Plat No. 3, which pertains to the following described land: Lot 1 and Out-Lot 1 of Certified Survey Map Doc. Key Issues (maximum of 5): The subdivision of land requires approval of a Preliminary Plat, followed by approval of a detailed Final Plat, which must substantially conform to the layout of the Preliminary Plat. A recorded Final Plat actually creates the lots, and may include the entire Preliminary Plat area or phases. The Preliminary Plat of Eagles Ridge No. 3 was th approved by the Plan Commission on August 9 . The Final Plat includes all of the Preliminary Plat area. As shown on the attached plat, the applicant has proposed the completion of Eagles Ridge Drive and the creation of 22 new single-family lots with an average lot area of 11,500 square feet. The subject property is already zoned R-1A, Single-Family Residential. The attached Location and Zoning Map shows the location of the platted area. The proposed street has a right-of-way width of 66 feet with pavement width of 32 feet, and will include new utilities and curb & gutter. Alliant Energy has requested slightly larger easements along the rear and some side lot lines. The other Review Agents have reviewed the Final Plat and do not have any comments or concerns. The Final Plat substantially conforms to the approved Preliminary Plat and the lots meet minimum standards. The applicant is not proposing the dedication of any additional parkland, and the Parks, Recreation, & th Conservation Advisory Commission recommended accepting fees in lieu of parkland dedication on August 9 . Key Issues (maximum of 5): The applicant has proposed a Class II Community Living facility for up to 10 children, ages 10-17, with a 30 day maximum stay. Under unusual circumstances, Rock County Family Court may extend the stay of a youth in the proposed shelter. This facility would temporarily house both male and female youths who are exclusively from Rock County and are either awaiting a longer term placement in foster care, group care, or in a brief respite before returning to their caregiver. The Goal of Derrick’s House LLC, is to provide an opportunity to place youths in a safe and stable residential setting. The applicant has expressed a need to relocate the current shelter care facility, known as the Youth Services Center (YSC), to a more inviting, residential setting. Purchase of properties from the Rock County Tax Foreclosure Proceedings

Overview/Background Information: Each year, the Rock County Treasurer provides a list of properties proposed to be taken through the tax foreclosure process. The City of Beloit has the ability to purchase properties in the City of Beloit before the properties are sold at public auction. Key Issues (maximum of 5): 1.
Attachment A identifies all of the properties being acquired by Rock County through the Tax Foreclosure process. It lists the existing land use and estimated amount that the City would have to pay Rock County to acquire these properties. Attachment A also identifies whether the property is located in one of the NRSA areas.

Similar to the last several years, the City does not have enough money to purchase all of the properties going into foreclosure. Therefore, we are recommending the purchase of houses in the Neighborhood Revitalization Strategy Areas (NRSAs). We are leaving the vacant lots in these areas at this time. In the future, we may recommend purchasing one of these lots if there is potential for redevelopment.

Attachment B includes a brief description of the properties proposed for purchase and a photo of the houses located on those properties.

All but one of the remaining houses are located outside of the NRSA neighborhoods. 402 Bluff Street is located in the NRSA. However, it is in the process of being condemned and is located in the Bluff Street Historic District. Since we are uncertain whether the lot could be redeveloped, we are opting not to purchase this property at this time.

RESOLUTION REQUIRING THE REPAIRS OF AT-GRADE RAIL ROAD CROSSINGS WHEREAS, fourteen public streets within the City of Beloit municipal boundaries cross the at-grade tracks of the Canadian Pacific Railway, and WHEREAS, section 86.12 of the Wisconsin statutes requires railroads to maintain public at-grade crossings in good condition and repair for public travel, and WHEREAS, the crossings at East Grand Avenue, Milwaukee Road, Prairie Avenue, Copeland Avenue, Summit Avenue, Henry Avenue, Bayliss Avenue, and Cranston Road by Pioneer Drive, are not in good condition and repair for public vehicle traffic, and the crossings at Shirland Avenue, State Street, Prospect Street, Park Avenue by Saint Paul Avenue, East Grand Avenue, Cranston Road by Kennedy Road, Milwaukee Road, Prairie Avenue, Copeland Avenue, Summit Avenue, Henry Avenue, Bayliss Avenue, Cranston Road by Pioneer Drive, Porter Avenue, and Park Avenue by Alice Avenue are not in good condition and repair for public pedestrian traffic, and WHEREAS, the City of Beloit hereby requires that Canadian Pacific Railway pave, plank, repair, or otherwise improve the crossing, as the needs require, and NOW THEREFORE, BE IT RESOLVED, that the City of Beloit hereby directs the City of Beloit staff to serve a copy of this resolution upon Canadian Pacific Railway requiring the railroad to repair the rail crossings at the afore mentioned public streets with the tracks of the Canadian Pacific Railway in the City of Beloit, Rock County. BE IT FURTHER RESOLVED, that in the event that Canadian Pacific Railway fails to repair the rail crossings within 30 days after service of the resolution, the City of Beloit City Council hereby directs the City of Beloit staff to take all necessary steps to petition the Office of the Commissioner of Railroads for an investigation and order for the repair of the rail crossings of the above names streets with the tracks of the Canadian Pacific Railway in the City of Beloit, Rock County. CITY OF BELOIT REPORTS AND PRESENTATIONS TO CITY COUNCIL Topic: Requiring the Canadian Pacific Railway to repair at-grade rail crossings in the City of Beloit Date:

Overview/Background Information: This resolution will order the railroad company to repair numerous rail crossings within the City of Beloit for pedestrian & vehicle traffic. Key Issues (maximum of 5): 1. In 2016, the City of Beloit Engineering Division issued sidewalk repair orders for the sidewalk located at Luety Park, and noted the deteriorated conditions of the pedestrian paths in the railroad crossings on Prairie & Copland Avenues. The City of Beloit also received a complaint about the condition of the pedestrian path at the railroad crossing located at Prairie Avenue. The Engineering Division sent the responsible rail road a sidewalk repair letter for those crossings in accordance with the annual sidewalk repair program. The timeframe given to the railroad passed without the required repairs happening. Given the additional requirements and considerations that need to be applied when working within or near the railway, the pedestrian paths could not be repaired by any normal concrete contractor. 2. Section 86.12 of the Wisconsin statutes requires railroads to maintain public at-grade crossings in good condition and repair for public travel. That section states that the governing body that has a deficient crossing pass a resolution ordering the repair of the crossing, and then be delivered to the railroad’s registered agent. 3. City staff determined that if a resolution is needed each time a repair is required, that staff should perform an inspection at all railroad crossings within the city limits, and order the necessary repairs for all crossings at the same time. 4. The rail crossings east of I-90 are owned and operated by a different railroad than the rail crossings west of I-90. A similar repair request is not being pursued at this time with Union Pacific Railroad. 5. Once this resolution is passed, and the Canadian Pacific Railway does not make the repairs within 30 days, the next step will be for staff to petition the Wisconsin Office of the Commissioner of Railroads for an investigation and intervention in this matter. Resolution Considering the Applications for Alcohol Beverage Operator’s (Bartender’s) Licenses [2017-2019 cycle through September 8, 2017]

Overview/Background Information: Applicants for an Alcohol Beverage Operator’s (Bartender’s) License must apply (or renew) on a bi-annual basis. This process requires an application, proof that a responsible beverage server training course was completed, payment of the applicable fee and submission to a background check of the Beloit Police Department. The City Council (as the governing body per state statute §125.17(1), Wis. Stats.) is required to approve all licenses prior to issuance. Immediate past practices are not compliant with state law. For this bi-annual application/renewal process, the application form was updated to conform to state law, apply best practices, and provide better information for the Police Department to conduct thorough background checks on each applicant. The attached resolution includes all applicants to date for the 2017-2019 renewal process up through September 8, 2017. Applicants who were denied are included at the conclusion of this list. Each denied applicant was provided a letter describing reasons for denial and information on their ability to appeal to the City Council. Council will see a list of applicants at each meeting hereafter. Key Issues: 1. The process for obtaining an Operator’s (Bartender’s) License in the City of Beloit requires multiple steps: a. Complete the application and proof of responsible beverage server training, show ID, pay applicable fees and background investigation. b. Upon completion of background investigation, the Police Department returns the application(s) to the Clerk-Treasurer with its recommendation for approval or denial. c. Applications recommended for denial are sent a letter stating the reasons for the recommendation of denial and the opportunity to appeal to the governing body. Applications recommended for approval and those that do not appeal are placed on the master list and submitted to Council every two weeks for consideration. d. Upon Council approval, City Clerk-Treasurer issues the license. 2. § 125.17(1), Wis. Stats., requires the governing body to approved qualified applicants prior to issuance of the license. 3. This license cycle runs July 1, 2017 through June 30, 2019. A 2-year cycle can generally include more than 800 licenses during that time [2015-2017 cycle included 815 Operators]. 4. This list includes 7 applicants taken between August 26, 2017 and September 8, 2017. 5. Future lists will include applicants in the prior two-week period, and if necessary, a provisional license may be issued to the applicant to complete the approval process. Should the applicant not be approved, their provisional license will expire and a new license will not be issued. 6. This process is consistent with state statute as well as guidance from the League of Wisconsin Municipalities guidance for Municipal Licensing and Regulation of Alcohol Beverages. RESOLUTION DISSOLVING TAX INCREMENTAL FINANCING DISTRICT No. 5 AND AUTHORIZING THE CITY CLERK/TREASURER TO DISTRIBUTE EXCESS INCREMENT TO OVERLYING TAXING DISTRICTS WHEREAS, the City of Beloit passed a creation resolution creating Tax Incremental Financing (TIF) District No. 5 on September 24, 1990 and adopted a project plan that same year, and; WHEREAS, all projects undertaken in accordance with the project plan for TIF District No. 5 were completed, to the extent that they were determined to be necessary, in the prescribed allowed time, and: WHEREAS, sufficient increment has been collected as of the 2017 tax roll, payable 2018, to cover the TIF District’s project costs. The City of Beloit passed a creation resolution creating Tax Incremental Financing (TIF) District No. 5 on September 24, 1990 and adopted a project plan that same year. TIF #5 is commonly referred to as the Downtown TID. All projects have been completed and the TID will receive final increment in 2018 which will be used to pay final debt service payments. The City Clerk/Treasurer shall notify the Wisconsin Department of Revenue within 60 days of this resolution or prior to the deadline of April 15, 2018, whichever comes first, that the District has been terminated. The City Clerk/Treasurer shall sign the required Wisconsin Department of Revenue final accounting form (PE-223) agreeing on a date by which the City shall send final audited information to the Wisconsin Department of Revenue. The City Clerk/Treasurer shall distribute any excess increment collected, after providing for ongoing expenses of the District, to the affected taxing districts with proportionate shares to be determined by the final audit done by the city’s auditors, Baker Tilly Virchow Krause, LLP.
