COMMITTEE OF ADJUSTMENT NOTICE OF PUBLIC HEARING APPLICATION FOR MINOR VARIANCE APPLICATION NO. DN/A-17:271 IN THE MATTER OF The Planning Act, R.S.O., 1990, c.P. 13, as amended and of the Zoning By-Law No. 3581-86, as amended, of the City of Hamilton (formerly Dundas), Sections 6, 7 18 and 20. AND IN THE MATTER OF the Premises known as Municipal number 37 Hatt Street, formerly in the Town of Dundas, now in the City of Hamilton and in a "C.A.C" (Central Area Commercial) district; AND IN THE MATTER OF AN APPLICATION by the agent J.H. Cohoon Engineering on behalf of the owner Heidi Gerber, for relief from the provisions of the Zoning By-Law No. 3581-86, as amended, under Section 45 of The Planning Act, R.S.O. 1990, c. P. 13, so as to permit the demolition of the existing enclosed rear porch and to construct a 2.44m (8’0”) x 8.24m (27’0%”) one storey rear addition together with a second storey rear balcony and a westerly open stairway/fire escape for a building to be altered to a residential-commercial building in order to facilitate Site Plan Application File # MDA-17074 notwithstanding that: 1. The dwelling unit shall be permitted on the same floor as the commercial use instead of the requirement that no residential use or part thereof shall be located on the same floor as a commercial use, except in such a manner as will completely segregate from any commercial use pedestrian movement to and from any residential use; 2. A minimum easterly side yard of 0.9m and a minimum westerly side yard of 3.5m shall be provided instead of the minimum required side yard of 4.5m; 3. Eaves and gutters shall be permitted to project not more than a 0.6m into the easterly side yard so that they may be as close a 0.3m to the easterly side lot line instead of the requirement that an eave or gutter may project into a required side yard (being 0.9m) not more than one-half of its width (being 0.45m); 4. A minimum rear yard of 5.3m shall be provided instead of the minimum required rear yard of 12.0m; 5. A minimum of two (2) parking spaces shall be provided instead of the requirement that one (1) parking space per 27.0m2 or fraction thereof of ground floor area plus one (1) parking space per 69.0m2 of remaining gross floor area is required for the Office of Other Health Practitioners and/or for Offices of Physicians, Surgeons and Dentists, Private Practice plus one (1) parking space for the one (1) dwelling unit; 6. The parking space or part thereof shall be 0.0m from the westerly lot line instead of the requirement no parking space or part thereof shall be located and no land shall be used for the temporary parking or storage of any motor vehicle at a distance of less than 1.0m from any lot line; 7. The parking space or part thereof shall be 0.0m from front lot line abutting Hatt Street instead of the requirement no parking space or part thereof shall be located and no land shall be used for the temporary parking or storage of any motor vehicle at a distance of less than 3.0m from any public thoroughfare;

The parking space or part thereof shall a minimum of 3.0m from the window to a habitable room instead of the requirement no parking space or part thereof shall be located and no land shall be used for the temporary parking or storage of any motor vehicle at a distance of less than 4.5 m from window of a habitable room measured in any direction; 9. A minimum 4.7m aisle width manoeuvring space shall be provided for the front (southerly) parking space instead of the minimum required 6.0m aisle width manoeuvring space; and, 10. A gravel surface shall be permitted for the parking area instead of the requirement that a permanent, durable and dustless surface that is graded, drained and paved with concrete, asphalt or other similar material, or any combination thereof shall be provided and maintained for every parking area, loading space, manoeuvring space and access driveway, unless an alternative type of surface material, such as an environmentally friendly permeable surface, is required as part of a Site Plan approved by Council under the relevant provisions of the Planning Act. NOTE: i.
The variances are necessary to facilitate Site Plan Application File # MDA-17-074.
ii. The building is intended to be altered from a single family dwelling to a residentialcommercial building containing the Office of Other Health Practitioner (physiotherapist) on the entire ground floor and part of the second floor and one (1) dwelling unit on the remaining portion of the second floor. iii. Pursuant to Variance # 1, the office and bathroom for the physiotherapy clinic is located on the 2nd floor which also contains the dwelling unit and both uses share a hall and a stairway access. iv. Pursuant to Variance # 5, based on the existing parking regulations, six (6) parking spaces are required for the portion of the building used for the Office of Other Health Practitioner (physiotherapist) which consists of 127.1m2 of gross floor area on the ground floor and 30.0m2 gross floor area on the second floor. If the gross floor areas of the ground floor or second floor used for the physiotherapist’s office are altered, additional parking spaces may be required. One (1) parking space is required for the second floor dwelling unit. v. Pursuant to Variance # 8, the setback distance of 3.0m is from the floor of the first floor to the floor of the second floor which contains the dwelling unit. Further, pursuant to Variance #’s 6, 7 and 8, the definition of parking space also includes the driveway and the aisle width manoeuvring space. AND IN THE MATTER OF the Premises known as Municipal number 2131 King St. E., in the City of Hamilton and in an "H" (Community Shopping and Commercial, etc.) district; AND IN THE MATTER OF AN APPLICATION by the agent Osama Abo Nassal on behalf of the owner Taha Alajeeli, for relief from the provisions of the Zoning By-Law No. 6593, under Section 45 of The Planning Act, R.S.O. 1990, c. Tandem parking shall be permitted where at least one or more parking spaces are located within a building/unit whereas the By-law requires that the accessibility to a parking space shall not be obstructed by any other motor vehicle as defined; and, 6. A minimum setback of 0.0m shall be permitted from the P5 (Conservation/Hazard Lands) zone boundary whereas the By-law requires all buildings or structures located on a property to maintain a setback of 7.5m from a P5 zone boundary. Notes: These variances are required to facilitate Site Plan Application DA-16-178. This application is to be heard in conjunction with Severance Applications HM/B-17:65 and HM/B-17:66. The submitted plan does not match the original plan submitted as part of the above noted Site Plan Control application.
