HM/A-17:172 IN THE MATTER OF The Planning Act, R.S.O., 1990, c.P. 13, as amended and o f the Zoning By-Law No. 6593, of the City o f Hamilton, Sections 9 ,1 8 , 18A & 19. AND IN THE MATTER OF the Premises known as Municipal num ber 96 Am elia St., in the City of Hamilton and in a "C" (Urban Protected Residential) district; AND IN THE MATTER OF AN APPLICATION by the agent Eric Canton on behalf o f the owner Jennifer Fairley, for relief from the provisions of the Zoning By-Law No. 6593, under Section 45 of The Planning Act, R .S .0 .1990, c. P. 13, so as to permit the construction o f a 2 storey additions with basem ent walk-out at the rear and east side o f the existing building and a covered porch at the front of the existing single fam ily dwelling in order to permit the future conversion o f the building into two (2) dwelling units notwithstanding that; Existing Single Family Dwelling: 1. A minimum side yard width of 0.7 m shall be provided on the easterly lot line instead o f the minimum required side yard width o f 1.2 m; 2. A minimum easterly side yard setback of 0.3 m shall be permitted for the eaves and gutters instead o f the minimum required 0.35 m; 3. A minimum o f two (2) parking spaces shall be provided on site instead o f the minimum required 4 parking spaces based on the proposed eleven (11) habitable rooms; 4. A minimum 4.8 m in length shall be provided fo r one o f the parking spaces instead o f the minimum required 6.0 m; 5. To permit two (2) parking spaces to be provided within the required front yard instead o f the requirement in the By-Law that states that only one o f the required parking spaces m ay be located in the front yard; and, 6. No manoeuvring on site shall be provided fo r the 2 parking spaces instead o f the minimum required manoeuvring space aisle width of 6.0 m.
Future Conversion Under Section 19: 1■ The existing appearance of the building shall be altered by the construction o f 2 additions with basem ent walk-out at the rear and east side whereas the By-Law states that the external appearance and character of the dwelling shall be preserved; 2. To allow outside stairs whereas the By-Law states that there shall be not outside stairs other than an exterior exit; 3. To permit two (2) parking spaces to be provided within the required front yard instead o f the requirement in the By-Law that states that only one o f the required parking spaces m ay be located in the front yard; 4. No manoeuvring on site shall be provided fo r the 2 parking spaces instead o f the requirement in the By-Law that states that manoeuvring fo r only one parking space may be provided off-site; and,

No details have been provided for the bump-out shown on the westerly side of the existing dwelling, therefore, further variances shall be required.
