Notes: Hamilton 05-200 Zoning By-Law: The subject lands are presently zoned “H” according to Hamilton Zoning By-law No. 6593. Be advised that By-law 17-240 was passed on November 8, 2017 which changed the zoning of this property from “H” to “C5” under Hamilton Zoning By-law 05-200. However, By-law 17-240 is not yet final. Notes: Variances have been written exactly as requested by the applicant. Please note, that this property is subject to Site Plan Control DAB-17-069; to date, a recirculation of the revised plan has not been submitted and a full zoning review has not been conducted for the new proposal. Further variances may be required at such time that a full zoning review is conducted on the new proposal. These variances are necessary to facilitate Site Plan Control Application DAB-17-069. The applicant requested a variance to the eave/gutter encroachment; however, if the requested variance #1 is approved, an eave/gutter may project a maximum of 0.4m into the required southerly side yard. The applicant shall ensure that the minimum ground floor elevation of the building is at 76.0m above mean sea level as defined by the Geodetic Survey Datum. The applicant shall ensure that the maximum permitted 11.0m height is not exceeded. While the proposed height appear to conform, the height dimension was not shown from grade as defined. Notes: If the front yard setback is approved for 2.1 m then the front yard eave encroachment of 0.46 m would be in compliance. An eave or gutter may project into a required front yard not more than 1.5 m provided no such projection shall be closer to a street line than 1.5 m. No details have been provided to determine zoning compliance; therefore, further variances may be required. .12
