AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS, AMENDING THE CODE OF ORDINANCES, CHAPTER 6, ARTICLE XI, ENTITLED “SIGNS,” BY REPEALING IN ITS ENTIRETY CHAPTER 6, ARTICLE XI, SECTION 6-256, ENTITLED “APPEALS TO SIGN ORDINANCE,” AND REPLACING IT WITH A NEW CHAPTER 6, ARTICLE XI, SECTION 6-256; ENTITLED “APPEALS TO SIGN ORDINANCE,” BY PROVIDING THE PROCESS FOR APPEALS OF DECISION OF THE SIGN BOARD OF APPEALS; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY OF A FINE NOT TO EXCEED TWO THOUSAND DOLLARS ($2,000) FOR EACH AND EVERY OFFENSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Council of the City of The Colony, Texas, finds and determines that it is necessary to amend Section 6-256 of the Code of Ordinances to address appeals of the Sign Board to City Council. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: SECTION 1. The findings set forth above are incorporated into the body of this Ordinance as if fully set forth herein. SECTION 2. That the Code of Ordinances of the City of The Colony, Texas be, and the same is, hereby amended by repealing in its entirety Chapter 6, Article XI, Section 6-256, and replacing it with a new Chapter 6, Article XI, Section 6-256, which shall read as follows: “Sec. 6-256. - Appeals to sign ordinance. (a)
Creation of board. There is hereby established a sign board of appeals consisting of five current members of the board of adjustment and alternates. Alternate members may serve as replacement members in the event of absence or disqualification.
(b)
Quorum. A majority of members, three or more members, shall constitute a quorum. In the event of the absence of the chairman and vice-chairman, the three or more members constituting the quorum shall elect for that meeting a member to preside and assume the duties as acting chairman. All motions shall be decided by a simple majority.
(c)
Meetings. All meetings shall be open to the public. The board shall establish the dates, times and places of meetings.
(d)
Records. All proceedings of the sign board of appeals shall be recorded in minutes of 8
meetings and such minutes approved and made a matter of public record. (e)
(f)
Powers and duties. The sign board of appeals shall have the following powers and perform the following duties: (1)
The sign board of appeals may hear and decide appeals which allege error in any order, requirement, decision, or determination made by the chief building official in connection with the refusal to grant a permit, revoke a permit, or a decision involving any substantive or material interpretation of this article.
(2)
A variance shall not be granted to relieve a self-imposed or personal hardship, nor shall it be based solely on economic gain or loss. In order to make a finding of hardship and to grant a variance from this article, the board must determine that: (A)
The requested variance does not violate the intent of the article.
(B)
The requested variance will not adversely affect surrounding properties.
(C)
The requested variance will not adversely affect public safety.
(D)
Special conditions exist which are unique to the applicant or property.
(E)
The requested variance is not self-imposed or granted to relieve personal a personal hardship.
(F)
The requested variance is not based solely on economic gain or loss.
(3)
All action regarding variances by the sign board of appeals may be appealed in accordance with subsection (f).
(4)
The sign board of appeals shall only exercise those duties which are provided in this article.
Appeal from sign board of appeals to city council. Any person aggrieved by the decision of the sign board of appeals may appeal the boards’ decision to city council. Such appeals shall be made in writing within ten (10) calendar days from the date of the board’s decision and shall be submitted to the city manager, or his designee. The director of planning or four (4) voting members of city council may likewise appeal the boards’ decision following the same appeal process. The city council’s decision is final. ”
SECTION 3. If any section, article paragraph, sentence, clause, phrase or word in this Ordinance, or application thereto any persons or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this Ordinance; and the City Council hereby declares it would have passed such remaining portions of this Ordinance despite such invalidity, which remaining portions shall remain in full force and effect. 9
SECTION 4. That all provisions of the Ordinances of the City of The Colony, Texas, in conflict with the provisions of this Ordinance be, and the same are hereby amended, repealed, and all other provisions of the Ordinances of the City not in conflict with the provisions of this Ordinance shall remain in full force and effect. SECTION 5. Any person, firm, or corporation violating any of the provisions of this Ordinance shall be deemed guilty of a misdemeanor and, upon conviction in the municipal court of the City of The Colony, Texas, shall be punished by a fine not to exceed the sum of Two Thousand Dollars ($2,000.00) for each offense. Every day a violation occurs shall constitute a separate offense. SECTION 6. This Ordinance shall become effective from and after its date of passage in accordance with law. These young athletes have shown excellent work ethic by achieving top recognition in winning either at the District, Regional or State Championship level. Mayor acknowledged The Colony High School Principal Tim Baxter and Coach Chuck Brown for receiving the Wrestling Coach of the Year award for 2017. 1.6 Recognize the new Municipal Court Administrator Director of Government Relations Brant Shallenburger recognized Constance White as the new Municipal Court Administrator. 1

REGULAR AGENDA ITEMS SUP17-0001 Pappy's Pet Lodge Specific Use Permit (SUP): Conduct a public hearing, discuss and consider an ordinance approving a request for Specific Use Permit (SUP) to allow Pappy's Pet Lodge at 4000 Paige Road to operate with the designated "outdoor play area" with stipulations concerning surface treatment and storm water pollution prevention, revoking SUP Ordinance # 2016-2221. Director of Development Services Surupa Sen reviewed the proposed request for Specific Use Permit to allow Pappy's Pet Lodge. She advised Council of the background and prior action, revised policy and procedures and the proposed awning location for this site. Ms. Sen stated with the proposed changes, the Development Review Committee feels confident that the outdoor play area can be utilized for the desired function (play/walk the pets) without contaminating the storm water drainage system and recommends approval of the proposed SUP. The Planning and Zoning Commission recommended approval on May 9, 2017. Council provided discussion on this item. The public hearing was opened and closed at 7:22 p.m. with there being no speakers. Z17-0001 Brentwood Court Townhomes Phase II - Zoning Change from Shopping Center (SC) to Townhouse Dwelling (TH) Zoning District: Conduct a public hearing, discuss and consider an ordinance approving a request for Zoning Change from Shopping Center (SC) to Townhouse Dwelling (TH) Zoning District allowing Town Homes Development at 5600 North Colony Boulevard being 1.4384 acres of land described as portion of Colony Park Baptist Church, Volume 1407, Page 435, DRDCT and all of Colony Park Baptist Church, Volume 1407, Page 431, DRDCT. Director of Development Services Surupa Sen reviewed the proposed request to allow zoning change of property located at 5600 North Colony Boulevard. She stated nineteen townhouse lots will be developed on a 1.44 acre of land. If approved the townhome development will have a total of 43 for-sale townhomes with an estimated average of $280,000 sale price. Ms. Sen advised Council of the developments screening plan and details, development standards and elevations. The Development Review Committee recommends approval and the Planning and Zoning Commission recommends approval of the request for zoning change from shopping center to townhouse dwelling zoning district.

Fernando Quintana Arbitrator with Executive Realty Group shared with Council the initiative taken by his company in communicating with neighbors in the community regarding the new development. Receive presentation, discuss and consider approval of updates to the City's Mosquito Management and Response Plan and expanded treatment zones if needed. Director of Parks and Recreation Pam Nelson briefed Council on the implementation of the mosquito management plan and changes to the response plan. Ms. Nelson introduced Patrick Prather with Municipal Mosquito who provided a presentation to Council on the difference of Emerging Mosquito Borne Diseases and Vector Control. Ms. Nelson gave an overview on this item providing a number of annual positive pool test results and current West Nile Virus plan of action. She noted there is an information page on the city’s website and an email address that can be used to send the city information on potential mosquito breeding sites. She reminded everyone of preventative measures people can take to reduce the chances of exposure. Motion to approve- Wade; second by Mikulec, motion carried with all ayes. 5.4
Discuss and consider approving an ordinance amending the budget to fund Bridges Cemetery restoration and Alley Fence replacement in the amount of $32,000 and award the headstone restoration portion of the project to Versar. Park Development Manager Eve Morgan reviewed the proposed budget amendment to fund restoration at Bridges Cemetery. She stated the project would be funded by the Lake Parks fund account of the Community Development Corporation. Motion to approve- Boyer; second by Marks, motion carried with all ayes. Discuss and consider approving an ordinance amending the budget for Stewart Creek Park - Entry Feature in the amount of $60,000 and awarding the design, construction and landscaping portions of the project. Park Development Manager Eve Morgan reviewed the proposed budget amendment for Stewart Creek Park entry feature. She stated the project would be funded through the Lake Parks fund account of the Community Development Corporation. 17

Discuss and consider approving a resolution authorizing the City Manager to execute the increase of Residential Solid Waste and Recycling rates by 2.1 percent and the increase of Commercial Solid Waste rates by 2.1 percent as specified in Appendix A. Assistant City Manager Tim Miller briefed Council on the proposed resolution. He stated the renewal contract stipulates a CIP increase based on the consumer price index. Mr. Miller advised the change will reflect an increase on an average residential bill of thirty to thirtyone cents. Motion to approve- Terre; second by Marks, motion carried with all ayes. Discuss and consider approving an ordinance prohibiting the use of NonFranchise Roll-Offs, Front-loaders, or other containerized units for the collection of residential construction and demolition materials. Director of Community Relations and Programming Joe Perez briefed Council on this item. Assistant City Manager Tim Miller stated there was a study performed to compare roll off rates to our neighboring cities with The Colony's rates being the same for each size of roll off due to the distance to the landfill. KNOW ALL MEN BY THESE PRESENTS:
THIS CONTRACT FOR DEPOSITORY AGREEMENT (the “Contract”) is made and entered into this ____ day of June, 2017 by and between the CITY OF THE COLONY, TEXAS, a Texas municipal corporation (hereinafter referred to as the “CITY”), and JPMORGAN CHASE BANK, N.A., a
national banking association
(hereinafter referred to as “DEPOSITORY”) and evidences the following:
I. PURPOSE DEPOSITORY shall provide depository banking services to the CITY as specified in Section II of this contract. The purpose of the services provided by DEPOSITORY under this Contract are to provide the CITY with a safe and secure depository bank for CITY funds and to provide such other services as set forth in this Contract and attached documents.
II. DESCRIPTION OF SERVICES The services, which DEPOSITORY shall provide for the CITY, shall include the following: A.
DEPOSITORY hereby covenants and agrees that it agrees to work closely with
the CITY’S City Manager, (hereinafter called “Manager”) or his chosen agent, and/or other appropriate officials of the CITY, and that it is to perform any and all tasks required of it to fulfill the purposes of this Contract. B.
DEPOSITORY and the CITY covenant and agree that DEPOSITORY shall
perform all of the services and work contained in DEPOSITORY’S account terms and 1

service Terms (“Account and Service Terms”), which is attached hereto as Exhibit A; said document being part of this Contract and incorporated in its entirety herein for all purposes. The parties agree that should there be any conflict between the Account Terms and Service Terms and this Contract, the provisions of this Contract, shall govern.
III. PERFORMANCE OF WORK DEPOSITORY, its associate and employees, shall perform all the work called for in this Contract. DEPOSITORY hereby covenants and agrees that all of its associates and employees who work on this project shall be fully qualified to undertake it and competent to do the work described in this Contract.
IV. TERM OF THE CONTRACT This Contract shall commence and be in full force and effect upon the signing of this Contract and observance of the appropriate formalities, or the 1st day of July, 2017. This Contract shall terminate on the 30th day of June, 2019. If mutually acceptable by both the DEPOSITORY and the CITY, the CITY shall have the option to continue the contract three terms for one year each by giving written notice to the DEPOSITORY at least 90 days prior to the end of the term. Pricing may be renegotiated prior to extension under the option. The term may be extended until such time as the successor shall have been duly selected and qualified, such extension not to exceed ninety (90) days. DEPOSITORY shall undertake commercially reasonable efforts necessary to fully and timely accomplish all services required under this Contract in accordance with “ordinary care" standard of care imposed upon banks under the Uniform Commercial Code.
V. COORDINATION DEPOSITORY represents that, prior to submitting its proposal upon this Contract and prior to signing this Contract, DEPOSITORY has become thoroughly acquainted 2

with all matters relating to the performance of this Contract. All services under this Contract shall be coordinated under, and performed to the satisfaction of the CITY.
VI. CONTRACT PERSONAL DEPOSITORY and the CITY hereby covenant and agree that this Contract provides for personal services and that these services are not to be assigned or sublet in whole or part without the prior written consent of the CITY. Notwithstanding anything to the contrary herein, DEPOSITORY may assign this Contract without the prior written consent of the CITY to a successor in interest in connection with a merger, reorganization, consolidation or a disposition of a particular business to which this contract relates, and may assign this Contract to an affiliate or subsidiary. In the event of an assignment, CITY shall have the right to terminate this Contract.
VII. CONFLICT OF INTEREST All activities, investigations and other efforts made by DEPOSITORY pursuant to this Contract will be conducted by employees or associates of DEPOSITORY. DEPOSITORY further understands that the Code of Ordinances for the City of The Colony prohibits an officer or employee of the CITY from having any financial interest, either direct or indirect, in any contract with the CITY. Any violation of this paragraph, which occurred, with the actual or constructive knowledge of DEPOSITORY will render this Contract voidable by the CITY. Notwithstanding anything to the contrary herein, the CITY acknowledges that DEPOSITORY may very well, within the ordinary course of its business, have loans to, maintain accounts for, or provide other banking services to CITY officials and employees, and in the course of the DEPOSITORY’S business, such activities are not considered to be a conflict of interest under the CITY’s Code of Ordinances to render this Contract voidable by the CITY. Further, the J.P. Morgan Code of Conduct prohibits any employee in general from acting on behalf of the bank in any transaction or business relationship involving such employee, members of his/her

family, or other persons or organizations with which such employee or his/her family have any significant personal connection or financial interest.
VIII. CHANGE IN WORK The CITY, through the Manager, may request changes in the scope and focus of the activities and studies called for under this Contract. Any such change which, in the opinion of DEPOSITORY and the Manager varies significantly from the scope and focuses of the work set out herein or entail a significant increase in cost or expense to DEPOSITORY, must be mutually agreed upon by DEPOSITORY and the CITY. The parties herein acknowledge that any change in the scope or focus of the work which results in the increase on compensation to DEPOSITORY must first be approved by the Manager or City Council of the CITY as applicable.
IX. CONFIDENTIAL WORK Any reports, information, project evaluations, data or any other documentation given to or prepared or assembled by DEPOSITORY under this Contract may not be made available to any individual or organization by DEPOSITORY without the prior written notice to the CITY. Notwithstanding the foregoing, any such information may be disclosed by DEPOSITORY as required by law or order or requested by any governmental agency or requested by any regulator having jurisdiction over DEPOSITORY or to defend or prosecute a claim brought against or by DEPOSITORY. In the event that DEPOSITORY is requested or required by law or order to disclose any of such information, DEPOSITORY shall attempt to provide the CITY with prompt written notice, unless notice is prohibited by subpoena, order or law, of any such request or requirement so that the CITY may seek a protective order or other appropriate remedy; provided, however, that DEPOSITORY shall not be required to notify the CITY regarding any disclosure of any such information or material to a regulator having jurisdiction over DEPOSITORY or its affiliates in the course of such regulator’s examination or inspection. 4

X. RECORDS The CITY may require copies of all papers and documents created by DEPOSITORY as a result of DEPOSITORY’S performance under this Contract. These copies may be requested by the Manager or his designee and will be reproduced by DEPOSITORY no later than ten (10) days from the date of such request. DEPOSITORY covenants and agrees that documents produced as a result of this Contract will be made available to the CITY, to subsequent CITY employees and/or to independent operators employed by the CITY upon request.
Notwithstanding anything to the
contrary herein, DEPOSITORY will allow the CITY’S auditors and independent public accountants, including where state or federal assistance is involved, state and federal auditors identified by the CITY, reasonable access during normal working hours to bank records of the CITY’S as reasonably required in connection with their examination of the books and records specifically pertaining to the CITY’S accounts, use of funds and services provided by DEPOSITORY to the CITY. Any access or examination will be: requested in writing; specifically describe the scope and records required; mutually agreed upon as to time and scope; and subject to DEPOSITORY’S security procedures and record retention policies. DEPOSITORY may impose reasonable restrictions on the number of individuals allowed access, the frequency and length of access, and the scope of the records made available. The CITY shall reimburse DEPOSITORY for the reasonable cost of copying, collating, researching and producing archived information. Any examination will be at the CITY’S expense.
XI. DEPOSITORY’S LIABILITY Approval of CITY shall not constitute nor be deemed a release of the responsibility and liability of DEPOSITORY, its employees, agents or associates for the accuracy and competency of their designs, reports, information, and other documents or services, nor, shall approval be deemed to be the assumption of such responsibility by

CITY for any defect, error, or admission in the documents prepared by DEPOSITORY, its employees, agents, or associates.
XII. NONDISCRIMINATION As a condition of this Contract, DEPOSITORY covenants and agrees that it will take all necessary actions to insure, in connection with any work under this Contract, that DEPOSITORY, or its associates, sub-contractors, or employees, will not discriminate in the treatment or employment of any individual or groups of individuals on the grounds of race, color, religion, national origin, age, sex, or physical handicap unrelated to job performance, either directly or indirectly or through contractual or other arrangements. In this regard, DEPOSITORY shall keep, retain and safeguard all records relating to this Contract for work performed hereunder for a minimum period of two (2) years from final contract completion, with full access allowed to authorized representatives of the CITY upon request, for purposes of evaluating compliance with this and other provisions of this Contract, subject to the CITY’S execution of a confidentiality agreement provided by the DEPOSITORY. Notwithstanding anything to the contrary herein, DEPOSITORY is subject to a documentation retention policy which governs the retention period for each particular form of documentation and other information; this policy is largely dictated by law and regulation of the various jurisdictions in which DEPOSITORY does business. The documentation retention policy will often require retention of documentation and information after the termination of DEPOSITORY’S relationship with the relevant customer. The period of retention beyond termination of the relationship with the CITY will be dependent on the type of information and will be governed by the documentation retention policy.
XIII. INDEPENDENT CONTRACTOR By the execution of this Contract, the CITY and DEPOSITORY do not change the independent contractor status of DEPOSITORY. No term or provision of this Contract or

any act of DEPOSITORY in the performance of this Contract may be construed as making DEPOSITORY the agent or representative of the CITY.
XIV. INDEMNIFICATION DEPOSITORY agrees to defend, indemnify and hold CITY, its officers, agents, and employees, harmless against any and all claims, lawsuits, judgments, costs and expenses for personal injury (including death), property damage or other harm for which recovery of damages is sought that directly arise out of DEPOSITORY’S negligent acts or omissions or willful misconduct of DEPOSITORY, its officers, agents, or employees, in the performance of this Contract; except to the indemnity provided for in this paragraph shall not apply to any liability resulting from the negligence of CITY, its officers, agents, employees or separate contractors, and in the event of joint and concurrent negligence of both the DEPOSITORY and CITY, responsibility, if any, shall be apportioned comparatively in accordance with the laws of the state of Texas, without however, waiving any defenses of the parties under Texas law. The provisions of this paragraph are solely for the benefit of the parties hereto and are not intended to create or grant any rights, contractual or otherwise, to any other person or entity. Notwithstanding anything to the contrary herein, DEPOSITORY’S liability for indemnification hereunder shall be invoked only to the extent that (i) the claimed damages, losses, and expenses are directly due to the negligence of DEPOSITORY and/or its subcontractors; (ii) DEPOSITORY’S indemnification obligations shall not exceed an amount, in the aggregate, over the term of the contract, an amount that exceeds one time (1) time the average annual revenues received by DEPOSITORY from the CITY under the contract; and (iii) neither party shall be liable to the other for any indirect, incidental, consequential, exemplary, punitive or special damages, including lost profits, regardless of the form of the action or theory of recovery, even if that party has been advised of the possibility of those damages or the same are reasonably foreseeable.

XV. NO VERBAL AGREEMENT This Contract contains the entire commitments and agreements of the parties to this Contract. Any verbal or written commitment not contained in this Contract or expressly referred to in this Contract and incorporated by reference shall have no force or effect. XVI. VENUE The parties to this Contract agree and covenant that this Contract will be performable in The Colony, Texas, and that if legal action is necessary to enforce this Contract, exclusive venue will lie in Denton County, Texas, except to the extent preempted by Federal law, in which case federal jurisdiction applies.
XVII. APPLICABLE LAWS This Contract is made subject to the existing provisions of the Charter of the City of The Colony, its rules, regulations, procedures and ordinances, present and future, and all applicable laws of the State of Texas and the United States.
XIII. CONTRACT INTERPRETATION The parties to this Contract covenant and agree that in any litigation relating to this Contract, the terms and conditions of this Contract will be interpreted according to the laws of the State of Texas, except to the extent pre-empted by Federal law, in which case Federal law shall govern.
XIX. NOTICES All notices, communications and reports under this Contract must be mailed or delivered to the respective parties at the addresses shown below, unless either party is otherwise notified in writing by the other party: 8

The contract has been amended three times previously in 2009, 2014 and 2016. The tenant now desires to amend the Lease Agreement to allow them to include a 5'x10' ground lease area so they can install an Emergency Generator. The City Attorney and staff have reviewed the Fourth Contract Amendment and recommend approval of this item. The initial yearly contract rental rate was $11,040.00. With the Fourth Contract Amendment, the new yearly rental rate will be $34,000.00 per year. Suggested Motion: I move to recommend approval of a resolution authorizing the City Manager to execute the Fourth Amendment to the Ground and Tower Lease Agreement with Verizon.

Staff Analysis Summary of Request Grandscape is one of the largest and most unique mixed-use real estate developments located in The Colony, Texas, in the heart of Dallas/Fort Worth, the 4th largest metropolitan area in the nation. The sprawling 400+ acre development will feature 3.9 million square feet of retail, entertainment, dining, hospitality, office and attractions. Grandscape is being developed by Nebraska Furniture Mart, a Berkshire Hathaway company and the developments first anchor. The home furnishings giant opened a 1.86 million square foot store in May 2015, offering furniture, flooring, appliances and electronics. The second phase of the Grandscape mixed-use development is being initiated through this Area 1A Development Plan and the Overall Phasing Plan review and approval. The fully buildout Grandscape Lifestyle Center will encompass roughly 90+ acres (over 2 million square feet of mixed-use development) adjacent the Nebraska Furniture Mart. Several first-to-market tenants and retailers will be announcing plans to join the project in the near future. Other infrastructure improvements are also expected to be underway in summer 2017. The Area 1A development plan includes a parking garage, surface parking, landscaping and utility work that is needed to happen before the first tenants can start working on their building layout and design. Future phases will be presented before the Commission and City Council for review and approval as the tenant specifications and other design parameters (site layout, parking distribution, interior connectivity, pedestrian access etc.) gets finalized. Existing Condition of Property The subject property is currently undeveloped. Platting Status The property is platted as part of Lot 3, Block A, Grandscape Addition Phase II. Project Overview This memorandum describes the methodologies of a February 2017 Traffic Impact Analysis (TIA) conducted for the proposed Grandscape Lifestyle Center located in the southwest corner of the Grandscape Boulevard and Destination Drive intersection in The Colony, Texas and describes the preliminary findings for recommendations pertaining to Area 1A. The proposed Grandscape Lifestyle Center is bordered by Nebraska Furniture Mart (NFM) to the south and west, Destination Drive to the east, and Grandscape Boulevard to the north of the site. The Sam Rayburn Tollway (SRT), also known as Highway 121, and it’s associated one-way frontage roads border the site to the north and facilitate a large amount of traffic through The Colony. Area 1A is focused on the section south of SRT between the NFM Main Entrance and Drive 3 located just east of South Colony Boulevard along Grandscape Boulevard. The February 2017 TIA evaluated existing, existing plus approved development, existing plus proposed Grandscape Lifestyle Center, and Future 2040 conditions to determine the impact of the site on the surrounding roadway network. The preliminary findings of the traffic impact analysis were reviewed by City of The Colony staff and Halff Associates, Inc. The review comments were summarized and discussed with City staff Tuesday, March 21st, 2017 and subsequent deliverables were identified including a revised traffic impact analysis report that will provide additional information and land use scenarios including a detailed review of the South Colony Boulevard and EB SRT Frontage Road Ramp intersection. The contents of this memorandum were also requested to provide an immediate description of the preliminary traffic impact analysis findings and summarize the report’s conclusions pertaining specifically to the geometric improvements required to accommodate the Grandscape Lifestyle Center development’s anticipated traffic volumes.

The preliminary February 2017 TIA considered approximately 1.5 million square feet of mixeduse development including restaurant, office, retail, and residential land uses based on a site plan dated January 16th, 2017 expected to generate approximately 38,243 daily, 3,458 PM peak hour, and 5,617 Saturday peak hour trips after considering a 20% internal capture rate. Trips were distributed to the roadway network and added to the existing plus approved volumes to identify appropriate roadway improvement recommendations. Recommendations were based on review of City standards and intersection capacity analysis results. Among items reviewed were warrants for signalization, auxiliary turn-lane accommodations, and weave segment analysis based on Federal Highway Administration (FHWA) Guidelines including the Institute of Transportation Engineers (ITE) and the Manual on Uniform Traffic Control Devices (MUTCD), The Colony Engineering Design Manual, intersection capacity analysis results based on Highway Capacity Manual (HCM) analysis methodologies, and engineering judgement. Based on the preliminary findings of the February 2017 TIA, the following intersection improvements were recommended for Area 1A to maintain typical levels of service at study intersections: Grandscape Boulevard with Drive 3 Provide signal control at the intersection and reconfigure the northbound approach exiting the site to accommodate three exiting lanes including two left-turn lanes, a shared through lane, and right-turn lane. o If design conditions limit the ability to provide dual left-turn lanes with a shared through/right-turn lane, an alternative configuration of a single left-turn lane, shared through/left-turn lane, and dedicated right-turn lane is recommended. With the alternative configuration, the intersection requires split-phased north/south operations which can be expected to operate similarly to the recommended configuration. o The attached Figure depicts operations with both traditional and split-phase phasing operations, in each case the intersection is anticipated to operate acceptably. Nebraska Furniture Mart Internal Drive Conditions Provide greater throat lengths along Drive 1 within the Nebraska Furniture Mart parking lot on the northeast corner of the building to provide less conflict along this drive. Grandscape Lifestyle Center Study Area Per City requests the final updated TIA will depict anticipated traffic volumes at the intersections of NFM Drive with Bargain Way as well as the SRT Frontage Road interchange with Plano Parkway. The final updated TIA will also provide further recommendations on wayfinding signage to direct development traffic to the appropriate locations within the site along the desired/most direct routes. An event scenario section will be provided to discuss conditions associated with an event traffic scenario, specific focus for this section will be direction on the SRT Frontage Road interchange with South Colony Boulevard, the intersection of South Colony Boulevard and Grandscape Boulevard with NFM Drive, as well as the intersection of EB SRT Frontage Road with Destination Drive. Additional comments regarding traffic control along the three internal roadways and the analysis of right turn lanes at study intersections have also been addressed as follows: Internal Roadway Traffic Control Grandscape Lifestyle Center Grandscape Boulevard & Destination Drive The Colony, Texas

The Drive 1 intersection with the NFM East Access is recommended to become an allway stop controlled intersection due to the anticipated traffic volumes at the intersection being relatively low and equal on all approaches. At the intersection of Drive 1 with Drive 2 it is recommended to provide a stop sign along Drive 2. Drive 2 is expected to produce significantly fewer trips than Drive 3, while the through volumes along Drive 1 are expected to be greater than vehicles attempting to enter along Drive 2. Stop signs are recommended along Drive 1 at the intersection with Drive 3 to provide a two-way stop condition allowing entering traffic free-flow to avoid queueing back to the parking drives and the signalized intersection with Drive 3 at Grandscape Boulevard. Volumes along Drive 1 are anticipated to be lower in comparison to entering volumes and adequate gaps are expected to develop allowing stopped vehicles to make maneuvers. The attached Figure depicts anticipated traffic volumes and level of service information for the internal roadway conditions described above. The analysis of these conditions will also be included and described within the final TIA.
Auxiliary Right-turn Lane Analysis Individual movement Level of Service (LOS) and queue information was reviewed along Grandscape Boulevard at the Drive 3 intersection and was determined that the current 6lane facility has adequate capacity to operate acceptably without the addition of dedicated right-turn lanes. Grandscape Boulevard is expected to continue to function adequately as a 6-lane facility with full development traffic, the addition of dedicated right-turn lanes was omitted as the outside lanes can be expected to operate as de-facto right-turn lanes. o The attached Figure depicts anticipated traffic volumes and level of service information with the recommended lane configurations as described above which includes operations along Grandscape Boulevard travel lanes operating in an acceptable range between Level of Service A and LOS C depending on the peak time period. Conceptual drawings of the requested intersections for the Area 1A described above included within the development site plan are Attached to illustrate recommended intersection conditions. The final updated TIA will be completed and provided to the City including the above described conditions.

WORK SESSION SI17-0002, Zoning Ordinance Amendments Receive a presentation from staff, review and discuss proposed Zoning Ordinance amendments regarding material for donation box, location requirement for accessory structures, exterior building materials under Gateway Overlay, portable on-demand storage containers and other miscellaneous sections within the Zoning Ordinance with inconsistencies or clerical errors.
Chairman Hames read the Work Session item 3.1 into record. Ms. Sen presented the staff report. Commissioner Pool expressed concern regarding limiting the number of days portable ondemand storage containers are allowed in residential zoning from 28 – 14 days. Ms. Sen answered that staff will share this feedback at the Ordinance Review Committee (ORC) meeting on Wednesday, May 24, 2017 and bring back an updated section for Commission review. Chairman Hames asked about how the “tree/plant list” was generated? Were there any arborist on Park Board who have reviewed this list. Ms. Sen responded that staff does not have that information. Staff will bring back an update at the next meeting regarding this item. Commissioner Rockenbaugh asked for clarification regarding removing fire safety requirements for town houses as structures. Ms. Sen stated that the section under question will refer to the currently adopted and amended International Fire Code (IFC). Commissioner Hebb asked if the color of the donation boxes will be required to match the primary structure on the property? Ms. Sen and City Attorney Ed Voss stated the pros and cons of such requirements. Chairman Hames asked for clarification on building exterior material requirements that is being proposed for amendment. Ms. Sen answered that the exterior material requirement in Gateway Overlay District only applies for commercial zoned properties. 4 4.1

Chairman Hames asked why the parking lot interior is not landscaped as required per code. Ms. Sen answered that landscape islands within surface parking lots are encouraged to be consolidated towards end caps and mid points to have efficient irrigation and large canopy trees are supported better in a larger square footage than separated islands. Mr. Ron Lazenby representing Grandscape approached Commission. He stated that due to a layer of surface parking is above the basement level garage to support the load of concrete, cars, people and dirt and tree on top of that will require huge support beams, reducing clear height for the garage level. Commissioner Rockenbaugh moved to approve Item 4.1 as stated, Commissioner DeBurr seconded the motion. Motion carried (5-0). 4.2

Chairman Hames read the Discussion item 4.2 into record. Ms. Sen presented the staff report. Commissioner Rockenbaugh asked where dumpster location will be within the townhouse development. Ms. Sen responded that during the zoning change process for this property the applicant had discussed with the Facilities Maintenance department regarding waste disposal. The town houses will have individual waste carts provided by the City’s waste management company, similar to the ones used in single family neighborhoods. The waste management company will pick up the trash from the townhouse project during their scheduled run. Commissioner also wanted to confirm that the Fire Marshall has reviewed the plans and is comfortable with the development having only one entry – exit point. Ms. Sen answered affirmative. Commissioner Rockenbaugh asked how many parking spaces are being proposed for the townhomes. Ms. Sen and applicant Mr. Packer explained that each unit will have 2 car attached garage and each unit have been pushed back on the lot to provide an 18’ long driveway in front of the townhouse. Commissioner Pool moved to approve Item 4.2 as stated, Commissioner DeBurr seconded the motion. Motion carried (5-0). 100

Staff Analysis Summary of Request P Custom Homes LLC proposes to develop a Luxury Townhouse project on the vacant land located at 4851 Westport overlooking Lake Lewisville. These three story townhome units will have a modern appearance with rooftop decks overlooking the lake. Three bedroom townhomes with an optional fourth bedroom/study/game room or media are proposed on the uphill residences ranging in size from 2850 to 3250 s.f. estimated sale price for the townhomes will vary from the high $300's to the low $400's. Home Owners Association (HOA) will be responsible for maintaining the exteriors and grounds and landscaping as well as the pool and open areas and screening wall. The up hill townhomes will have lake vicw from the living area and roof top entertainment decks. The townhomes facing the lake will have views from the master bed room, living room and open air roof deck. The site will include a community pool and grilling area with views of the lake for the residences. Access will be provided to the City hike and bike trail on the Army Corp property directly behind the townhouses. In compliance with the Fire Code each townhome will be fully sprinkled with 2 hour rated fire walls separating each unit. A masonry screening wall will be built between the townhome property and the properties to the east. The developer is willing to improve the parts of Westport Drive and provide landscaping within right of way of Westport Drive. Development Standards The ordinance approved by City Council on January 17, 2017 that allowed Planned DevelopmentTownhouse zoning on this property included the following development standards. The development Plan, Preliminary and Final Plats for this project does adhere to these development standards.

Chairman Hames read the Work Session item 3.1 into record. Ms. Sen presented the staff report. Commissioner Pool expressed concern regarding limiting the number of days portable ondemand storage containers are allowed in residential zoning from 28 – 14 days. Ms. Sen answered that staff will share this feedback at the Ordinance Review Committee (ORC) meeting on Wednesday, May 24, 2017 and bring back an updated section for Commission review. Chairman Hames asked about how the “tree/plant list” was generated? Were there any arborist on Park Board who have reviewed this list. Ms. Sen responded that staff does not have that information. Staff will bring back an update at the next meeting regarding this item. Commissioner Rockenbaugh asked for clarification regarding removing fire safety requirements for town houses as structures. Ms. Sen stated that the section under question will refer to the currently adopted and amended International Fire Code (IFC). Commissioner Hebb asked if the color of the donation boxes will be required to match the primary structure on the property? Ms. Sen and City Attorney Ed Voss stated the pros and cons of such requirements. Chairman Hames asked for clarification on building exterior material requirements that is being proposed for amendment. Ms. Sen answered that the exterior material requirement in Gateway Overlay District only applies for commercial zoned properties. 4 4.1

Chairman Hames asked why the parking lot interior is not landscaped as required per code. Ms. Sen answered that landscape islands within surface parking lots are encouraged to be consolidated towards end caps and mid points to have efficient irrigation and large canopy trees are supported better in a larger square footage than separated islands. Mr. Ron Lazenby representing Grandscape approached Commission. He stated that due to a layer of surface parking is above the basement level garage to support the load of concrete, cars, people and dirt and tree on top of that will require huge support beams, reducing clear height for the garage level. Chairman Hames read the Discussion item 4.2 into record. Ms. Sen presented the staff report. Commissioner Rockenbaugh asked where dumpster location will be within the townhouse development. Ms. Sen responded that during the zoning change process for this property the applicant had discussed with the Facilities Maintenance department regarding waste disposal. The town houses will have individual waste carts provided by the City’s waste management company, similar to the ones used in single family neighborhoods. The waste management company will pick up the trash from the townhouse project during their scheduled run. Commissioner also wanted to confirm that the Fire Marshall has reviewed the plans and is comfortable with the development having only one entry – exit point. Ms. Sen answered affirmative. Commissioner Rockenbaugh asked how many parking spaces are being proposed for the townhomes. Ms. Sen and applicant Mr. Packer explained that each unit will have 2 car attached garage and each unit have been pushed back on the lot to provide an 18’ long driveway in front of the townhouse. CITY OF THE COLONY, TEXAS ORDINANCE NO. ____________ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS, ADOPTING DAY CAMP STANDARDS OF CARE, A COPY OF WHICH IS ATTACHED HERETO AS EXHIBIT “A”; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN IMMEDIATE EFFECTIVE DATE. WHEREAS, Section 42.041 of the Texas Human Resources Code provides generally that no person may operate a child-care facility or child-placing agency without a license issued by the Texas Department of Family and Protective Services. Moreover, Section 42.041(b)(14) of the Texas Human Resources Code provides this statutory requirement does not apply in pertinent part to an elementary-age (ages 5-13) recreation program operated by a municipality provided the governing body of the municipality annually adopts standards of care by ordinance after a public hearing for such programs, that such standards are provided to the parents of each program participant, and that the ordinances shall include, at a minimum, staffing ratios, minimum staff qualifications, minimum facility, health, and safety standards, and mechanisms for monitoring and enforcing the adopted local standards; and further provided that parents be informed that the program is not licensed by the state and the program may not be advertised as a child-care facility; and WHEREAS, the City Council of the City of The Colony, Texas, has determined that the following regulation is necessary in order to protect public health, safety, and welfare of the citizens of the City of The Colony, Texas. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: SECTION 1. The findings set forth above are incorporated into the body of this Ordinance as if fully set forth herein. SECTION 2. City of The Colony Standards of Care for Kidz Kamp Day Camp Programs PURPOSE The following Standards of Care are intended to be minimum standards by which the City of The Colony Parks and Recreation Department will operate the City’s Kidz Kamp day camp programs. These programs operated by the City of The Colony are recreational in nature and are not licensed by the State of Texas nor operated as day care programs. Adoption of these Standards of Care will allow the City to qualify as being exempt from the requirements of the Texas Human Resources Code. General Information/Administration A.
Organization 1.
The governing body for the City of The Colony Kidz Kamp programs is the City Council of the City of The Colony, Texas.
2.
Implementation of the Standards of Care for Kidz Kamp is the responsibility of the Community Services Director and Parks and Recreation Department employees.
3.
The Standards of Care for Kidz Kamp will apply to any Kidz Kamp program including Holiday Kamp, Spring Break Kamp, and Summer Kamp.
4.
The Colony Recreation Center will have available for public review a current copy of the Standards of Care.
5.
Parents of participants will be provided access to a current copy of the Standards of Care through the City’s web site.
6.
Criminal background checks will be conducted on prospective Kidz Kamp employees, when applicable, and consistent with state law. If results of that criminal check indicate that an applicant has been convicted of any of the following offenses, he or she will not be considered for employment: a.
A felony or misdemeanor classified as an offense against a person or family;
b.
A felony or misdemeanor classified as public indecency;
c.
A felony or misdemeanor violation of any law intended to control the possession or distribution of any controlled substance;

d.
Any offense involving a crime of moral turpitude;
e.
Any offense that is deemed to potentially put the City of The Colony or Kidz Kamp participants at risk.
Definitions 1.
City: City of The Colony.
2.
City Council: City Council of the City of The Colony.
3.
Department: Parks and Recreation Department.
4.
Director: City of The Colony Director of Community Services.
5.
Kidz Kamp: City of The Colony youth camp program held during school holidays.
6.
Parent Handbook: Booklet of Kamp policies, procedures, required forms and organizational and programming materials relevant to the Kidz Kamp program.
7.
Recreation Coordinator: City of The Colony’s full time programmer who has been assigned administrative responsibility for the City of The Colony’s Kidz Kamp program.
8.
Recreation Manager: Recreation Coordinator’s supervisor who will handle administrative responsibility for the City of The Colony’s Kidz Kamp program in the Recreation Coordinator’s absence.
9.
Employee or Counselor: Someone who has been hired to work for the City of The Colony and has been assigned responsibility for managing, administering, or implementing some portion of the City of The Colony’s Kidz Kamp programs.
10.
Program Site: The Colony Recreation Center or LISD schools.
11.
Participant: A youth whose parent(s) have completed all required registration procedures and who has been determined to be eligible for the City of The Colony’s Kidz Kamp.
12.
Parent(s): A parent or guardian who has legal custody and authority to enroll a child in the City of The Colony’s Kidz Kamp.

Inspection/Monitoring/Enforcement 1.

The Recreation Coordinator will make visual inspections of the program based on the following schedule: a.
Summer Kidz Kamp will be inspected twice during the summer.
b.
Holiday Kidz Kamp (Thanksgiving and Winter) will be inspected once.
c.
Spring Break Kidz Kamp will be inspected once.
Complaints regarding enforcement of the Standards of Care will be directed to the Coordinator. The Coordinator will be responsible for taking the necessary steps to resolve the problems. Complaints regarding enforcement of the Standards of Care and their resolution will be recorded by the Coordinator. Serious complaints regarding enforcement of the Standards of Care will be addressed by the Recreation Manager and the complaint and resolution will be noted.
Enrollment 1.
Before a child can be enrolled, a parent/guardian must sign registration forms that contain the child’s: a.
Name, address, home telephone number
b.
Parent/Guardian’s name, address and telephone numbers during program hours Emergency contacts including names and phone number during program hours
d.
Names and driver’s license numbers of people to whom the child may be released
e.
A statement of the child’s special problems, needs or medical conditions

Emergency medical authorization

Permission for field trips

Suspected Abuse Program employees will report suspected child abuse or neglect in accordance with the Texas Family Code. In the case where a City employee is involved in an incident with a child that could be construed as child abuse, the incident must be reported immediately to the Recreation Coordinator and Recreation Manager. The Recreation Manager will immediately notify the Police Department and any other agency as may be appropriate. Texas state law requires the staff of these youth programs to report any suspected abuse or neglect of a child to the Texas Department of Protective and Regulatory Services or a law enforcement agency. Failure to report suspected abuse is punishable by fine up to $1,000 and/or confinement up to 180 days. Confidential reports may be made by calling 1-800-252-5400.
F.
Staffing – Responsibilities and Training 1.
Recreation Coordinator and Recreation Manager a.
Recreation Coordinator and Recreation Manager are full-time, professional employees of the City of The Colony Parks and Recreation Department and will be required to have all the same qualifications as outlined in Section F.2. below.
b.
Recreation Coordinator and Recreation Manager must meet the minimum education/experience requirements for employment with the City of The Colony to plan and implement recreation activities.
c.
Recreation Coordinator and Recreation Manager must be able to pass a background investigation including a test for illegal substances.
d.
Recreation Coordinator and Recreation Manager must have a current certification in First Aid, Cardio Pulmonary Resuscitation (CPR) and AED. All certifications must be current during the camp operation.
e.
Recreation Coordinator is responsible for administering the programs’ daily operations in compliance with the adopted Standards of Care.
f.
Recreation Coordinator is responsible for hiring, supervising, and evaluating the Kidz Kamp Director, Kidz Kamp Assistant Directors and Kidz Kamp Counselors.
g.
Recreation Coordinator is responsible for planning, implementing, and evaluating programs. 139

Kidz Kamp Staff a.
Program employees include Kidz Kamp Director, Kidz Kamp Assistant Director, and Kidz Kamp Counselors.
b.
Program employees may be full-time, part-time, or temporary employees of the Parks and Recreation Department.
c.
Program employees shall be age 16 or older. However, each site will have at least one employee age 18 or older on site at all times.
d.
Program employees should consistently exhibit competency, good judgment and self-control when working with participants.
e.
Program employees must relate to participants with courtesy, respect, tolerance and patience.
f.
Program employees must have a current certification in First Aid, Cardio Pulmonary Resuscitation (CPR) and AED. All certifications must be current during the camp operation.
g.
Program employees must pass a background investigation when applicable, including testing for illegal substances.
h.
Program employees will be responsible for providing participants with an environment in which they can feel safe, enjoy wholesome recreation activities, and participate in appropriate social opportunities with their peers.

Program employees will be responsible to know and adhere to all City, Departmental, and youth program standards as well as policies and procedures that apply to the youth programs.
j.
Program employees must ensure that participants are only released to a parent or authorized person, designated by the parent or guardian. If a parent wishes their child to sign himself in or out the parent must provide specific, written authorization.
Training and Orientation a.
The department is responsible for providing training and orientation to program employees in working with children and for specific job responsibilities. 140

Program employees must be familiar with the Standards of Care for Kidz Kamp programs as adopted by the City Council.
d.
Program employees must be familiar with the program policies including discipline, guidance, and release of participants as outlined in the staff manual.

Program employees will be trained in appropriate procedures to handle emergencies.
f.
Program employees will be trained in areas including city departmental program policies, procedures, leading activities, safety issues and organization.
g.
Program employees will be required to sign an acknowledgement that they have received the required training.
Operations 1.

Staff to Participant Ratio a.
The standard ratio of participants to staff is 1:15 based on average daily attendance. In the event a program employee is unable to report to the program site, the coordinator will assign a replacement.
b.
Program employees are responsible for being aware of the participants’ habits, interests, and special needs as identified by the participants’ parent/guardian during the registration process.
Discipline a.
Program employees will implement discipline and guidance in a consistent manner based on the best interest of program participants.
b.
There will be no cruel treatment or harsh punishment.
c.
Program employees may use brief, supervised separation from the group if necessary.
d.
As necessary, program employees will initiate behavior reports to the parents of participants. Parents will be asked to the sign the behavior 141
reports to indicate they have been advised about specific problems or incidents.

A sufficient number and/or severe nature of a discipline report(s) as indicated in the program manual may result in a participant being suspended from the program.
f.
In instances where there is a danger to other participants or staff, offending participants will be removed from the program site as soon as possible.
Programming a.
Program employees will attempt to provide activities for each group according to participants’ age, interests and abilities. The activities will be appropriate to participants’ health, safety and well-being. The activities must be flexible and promote the participants emotional, social and mental growth.

Program employees will attempt to provide indoor and outdoor time periods to include: -

Seatbelts must be worn when provided.
Facility Standards 1.
Safety a.
Program employees will inspect the program site daily to detect sanitation and safety concerns that might affect the health and safety of the participants. A weekly inspection report will be completed by the program employees and kept on file by the Coordinator.
b.
Buildings, grounds, and equipment on the program site will be inspected, cleaned, repaired, and maintained to protect the health of the participants.
c.
Program equipment and supplies should be safe for the participants’ use.

Program must have first aid supplies readily available at each site, during transportation to an off-site activity, and for the duration of the off-site activity.

Air conditioners, electric fans, and heaters must be mounted out of participants reach or have safeguards that keep participants from being injured.
Fire a.
In case of fire, danger or fire, explosion or other emergency, program employees’ first priority is to evacuate the participants to a designated safe area.
b.
Each program site must have at least one fire extinguisher approved by the fire marshal readily available to all program employees.
c.
All program employees will be trained in proper use of fire extinguishers as well as locations of fire extinguishers through the program site.
Illness or Injury a.
A participant who is considered to be a health or safety concern to other participants or employees will not be admitted to the program.
b.
Illnesses or injuries will be handled in a manner to protect the health of all participants and employees.
c.
Program employees will follow plans to provide emergency care for injured participants with symptoms of an acute illness as specified in the program manual.
d.
Program employees will follow the recommendation of the Texas Department of Health concerning the admission or readmission of any participant after a communicable disease.
Medication a.
Parent/guardian must complete and sign a medication release that provides authorization for program staff to dispense medication with details as to times and dosages. The release will include a hold harmless clause to protect the City.

Prescription medications must be in the original containers labeled with the participants’ name, a date, directions and the physician’s name. The prescribing physician must provide written guidelines. Program employees will administer medication only as stated on the label. Program employees will not administer medication after the expiration date.

Non-prescription medications are labeled with the participant’s name and the date the medication was brought to the youth program. Nonprescription medication must be in the original container. The program employees will administer medication only according to the label directions and with written parental permission.
d.
Medications dispensed will be limited to those not requiring special knowledge or skills on the part of the program employees.
e.
Program employees will ensure medications are inaccessible to participants. If necessary, medication will be kept in the refrigerator.
Special Needs a.
Every reasonable accommodation will be made to address special needs participants.
b.
For health and safety reasons, special needs participants must provide a personal attendant for assistance in feeding, changing of clothes, and using the restroom if needed.
Toilet Facilities a.
The program site will have toilets located inside and equipped so participants can use them independently and program employees can monitor as needed.
b.
There must be one flush toilet for every 30 participants. Urinals may be counted in the ratio of toilets to participants, but must not exceed 50% of the total number of toilets.
c.
An appropriate and adequate number of lavatories will be provided.
Sanitation a.
Program sites must have adequate light, ventilation, air conditioning and heat. 145
b.
The program must have an adequate supply of water meeting the standards of the Texas Department of Health for drinking water and ensure that it will be supplied in a safe and sanitary matter.

Employees must see that garbage is removed from buildings daily.
