Minutes of the General Membership/Executive Board meeting held on Thursday, September 4, 2008 at the JFK Airport Ramada Inn, Flushing, New York. The Executive Board Meeting was called to order at 1700 hours by President Danese with a salute to the flag and a moment of silence for all departed Police Officers. TREASURER’S REPORT: Treasurer R.J. White reported on the expenditures and income for the preceding month. All accounts are in the black; all bills are paid and current. Treasurer R.J. White reminded the membership that monies allocated to the PAC funds are not tax deductible. Additionally, the Chairman of the Board of Trustees Robert Egbert stated that as per the rules ofthe PBA Plan and Trust, a member who falls below the Port Authority’s sick standards in a twelve month period is not eligible for supplemental income benefits under the Plan and Trust until they meet the standard in PDI 2-9. COMMITTEE REPORTS: Grievance and Complaint Committee Committee Chairman/Executive Secretary Dom Evangelista reported that his scheduled informal grievance meeting with the Port Authority was cancelled due to a Port Authority employee assigned to investigate PBA grievances went out sick. Her illness lasted a little over three weeks and therefore, the PBA had no opportunity to present these informal grievances. She is back to work now and a date of September 1 5th has been scheduled forthis informal grievance meeting. Many grievances have been filed within the last month and a half and hopefully we can convince the Port Authority to resolve many of them. -
Pension and Legislative Committee Committee Chairman Second Vice President Robert Morris reported that in Albany, the Heart Bill clarification and Heart Bill clarification II just for disability and not for accidental death legislation has been vetoed by the Governor. The 9-11 Task Force recommendations have been signed by the Governor. The key changes for our members are: a Presumption now covers first responders who worked for any period oftime within the first 48 hours after the first plane hit the World Trade Center at the site locations. b Registration deadlines for Workers Compensation Law extension and the filing date for presumptive accidental disability for NYS will be extended to September 11, 2010. c Presumption forms may now be filed by legal beneficiaries after death, enabling one PAPD widow to file the presumption form as legal beneficiary. -
Until suchtime as the NYS Pension System creates a new form forthe additional eligibility requirements, form RS 6047-N will be used. Please write in "as per chapter 489 of 2008" along the bottom of the form if you are filing based upon working in the first 48 hours. In Washington, a bill sponsored by Congresswoman Maloney known as "James Zadroga 9/11 Health and Compensation Act" has been drafted and as the language presently stands, it will be difficult for any police union to support. This legislation would provide funding for long-term monitoring, treatment and research for individuals who are sick or become sick as a result of responding to 9/11. This bill would also reopen the victim’s compensation fund for rescue workers who were hurt. The issue with the language ofthis bill is that ofunequal criteria to qualify for any ofthe above benefits. As presently drafted: "A FIRE FIGHTERS AND RELATED PERSONNEL. All members ofthe Fire Department ofthe City ofNew York whether fire or emergency personnel, active or retired who participated at least one day in the rescue and recovery effort at any ofthe former World Trade sites including Ground Zero, Staten Island landfill and the New York City Chief Medical Examiner’s office for any time during the period beginning on September 11, 2001 and ending on July 31, 2002. -
B OTHER WTC RESCUE, RECOVERY AND CLEAN UP WORKERS. The individual i worked or volunteered on-site in rescue, recovery, debris-cleanup or related support services in lower Manhattan south of Canal Street, the Staten Island landfill or the barge loading piers, for at least 4 hours during the period beginning on September 11, 2001, and ending on September 14, 2001, for at least 24 hours during the period beginning on September 11, 2001 and ending on September 30, 2001 or for at least 80 hours during the period beginning on September 11, 2001 and ending on July 31, 2002." -

As the language clearly shows in its present form, we are second class citizens to the FDNY. I urge you to contact the sponsors ofthis bill at the telephone numbers listed below and voice your displeasure and request equal criteria police.

Election Committee President Danese reported that P.O. Raymond Corbo PN ran unopposed for PBA/PN delegate and we congratulate and welcome him to the Executive Board. The Recording Secretary will cast one vote for P.O. Corbo and he is deemed elected. -
Judiciary Committee Committee Chairman Mike DeFilippis reported that a police officer LT has complied with the instructions from the Committee and recommends that the charges against the police officer be dropped and the matter deemed closed. -
Motion #4 By M. Shea LGA, seconded by C. Carini BT, to adopt the recommendation of the Judiciary Committee on the above matter. On the vote all in favor motion carried. -

UNFINISHED BUSINESS: President Danese requested that eachdelegate obtain copies ofthe new and old roll calls for all tours preferably pre 9-11 and post 9-11 and send them to Dominick Evangelista at the PBA office. In addition, submit the names to the PBA of all police officers who were transferred from the Police Academy and never left their commands. President Danese reported that with respect to the new roll calls, he instructed our attorney to research case law on the issue of litigation against a police agency for a disregard of police officer safety due to staffing. President Danese will keep the membership advised. A discussion ensued regarding a memo for ESU/Tactical Rail Interdiction Training. The SOD/PBA delegates are to conduct a poll of the ESU police officers as to how the training is to be scheduled either by truck assignments or seniority within ESU.
NEW BUSINESS: Motion #5 By S. Morsi JFK, seconded by R. Egbert, to hold the October 23, 2008 PBA General Membership/Executive Board meeting at 5:00 p.m. at the NIA Marriott Hotel, Newark, New Jersey and to hold the November 2008 General Membership/Executive Board meeting on November 25, 2008. On the vote all in favor motion carried. -
