A public hearing of the Gates Zoning Board of Appeals was called to order by CHAIRPERSON MAURICE at 7:30 p.m. at the Gates Town Hall. CHAIRPERSON MAURICE explained the purpose and procedure of the Zoning Board. ***** CHAIRPERSON MAURICE – States that the first order of business is to accept the minutes from November, 2016 meeting as there was no meeting in December. No changes, additions or corrections to be made. MOTION to accept November minutes - MR DISHAW Second - MR. CORDERO All in favor. CHAIRPERSON MAURICE – the Board is meeting tonight, although no agenda items are being heard, to put what is happening on the record. THE APPLICATION OF DAVID DAILEY, AS AGENT FOR BIRCHCREST TREE AND LANDSCAPE, REQUESTING AN AREA VARIANCE AND A CONDITIONAL USE PERMIT FROM ARTICLE VI, SECTION 190-33(C) TO ALLOW A FENCE (WITH BARB WIRE) TO REMAIN WHICH IS HIGHER THAN ALLOWED ON PROPERTY LOCATED AT 150 LEE ROAD CHAIRPERSON MAURICE - The application was not complete as it was presented for this meeting so the applicant has agreed to withdraw the current application and submit a new application which will most likely be heard at the February meeting. No public hearing on this application tonight. TABLED FROM OCTOBER, 2016 MEETING THE APPLICATION OF DAVID YOUNGMAN REQUESTING AN AREA VARIANCE AND CONDITIONAL USE PERMIT UNDER ARTICLE VI SECTION 190-32 AND ARTICLE VIII, SECTION 190-36 TO ERECT A FENCE TO REMAIN WITHIN THE FRONT SETBACK AND HIGHER THAN ALLOWED WITHIN THE PROPERTY LOCATED AT 615 COLDWATER ROAD, TOWN OF GATES, NEW YORK. CHAIRPERSON MAURICE - The matter had to be tabled and then the applicant missed a meeting. The applicant was going to come in December but the Board asked him to put it off another month because it would have been the only application for that meeting. He agreed to come in January, but due to an administrative error, it was not on the agenda for this January meeting, therefore, it did not go into the newspaper to be published, so would not have been able to have a public hearing. Here tonight to acknowledge this and it remains tabled. Someone will make sure that it is on the agenda for the February meeting.
