HM/A-16:155 iN THE MATTER OF The Planning Act, R.S.O., 1990, c.P. 13, as amended and of the Zoning By-Law No. 6593, of the City of Hamilton, Sections 14, 18A and 19. AND mN THE MATTER OF the Premises known as Municipal number 1068-1072 Barton St. E., in the City of Hamilton, and in an "H" (Community Shopping and Commercial, etc.)
district; AND IN THE MATTER OF AN APPLICATION by the owner Kevin Lu, for relief from the provisions of the Zoning By-Law No. 6593, under Section 45 of The Planning Act, R.S.O.
1990, c. P. 13, so as to permit the existing building to be converted to contain a total of five (5) dwelling units on the second and third floors together with three (3) commercial units on the ground floor notwithstanding that: 1.
A minimum rear yard depth of 0.0m shall be provided instead of the minimum required
rear yard of a depth of 7.5 metres for a building used partly for human habitation and a rear yard depth of 4.5m in all other cases.
2.
No loading space shall be provided instead of the minimum required one (1) loading
space being 3.7m wide x 9.0m long x 4.3m high.
3. Tandem parking shall be provided for two parking spaces so that one parking space may obstruct another parking space instead of the requirement that sufficient space additional to required parking space shall be provided and maintained on the same lot on which the parking space is located, in such a manner as to enable each and every parking space to be unobstructed and freely and readily accessible from within the lot, without moving any vehicle on the lot or encroaching on any designated parking space. 4. Easy access is not provided to the Barton Street East access driveway instead of the requirement that every access driveway shall provide easy access from a highway to the parking area to which the access driveway is accessory. 5. A minimum two-way access driveway width of 3.0m shall be provided for the access driveway onto Barton Street East instead of the minimum required two-way access driveway width of 5.5m.
NOTE: i) The applicant has advised that Units 102 and 103 are intended to be used for retail or offices. Be advised that medical offices would not be permitted as there is insufficient parking for this use. As such, if medical offices are intended in any of the commercial units in the future, a successful application for minor variance will be necessary in order to reduce the required on-site parking spaces.
ii) The two (2) required visitor parking spaces for the five (5) dwelling units have not been identified on the Site Plan. As such, visitor parking spaces are required to be provided in accordance with Section 18A(16) of Hamilton Zoning By-law 6593. If visitor parking spaces are not provided, a further variance shall be necessary.
iii) If lighting of the parking area is intended it shall be directed towards or on the lot on which the parking area is located and away from any adjacent use and any highway.

Notes: Variances have been written exactly as requested by the applicant. This property is subject to Site Plan Control; to date, no formal site plan application has been submitted and a full zoning review has not been conducted for the proposed development. Further variances may be required at such time that a formal zoning review is conducted on the proposed development.
The 'H' Holding provision shall be removed prior to the commencement of the proposed development. Please note that until the 'H' symbol is removed, these lands may only be used for uses existing at the date of the passing of the By-law. The recognized use is vacant lands. Therefore, no new development or new uses are permitted on these lands at this time.
According to the Site Specific LC-7(H), the portion of the lands measuring from the front lot line a distance of 71.0m along the easterly lot line and 37.0m along the westerly lot line shall only be used for a gas bar, manual or automatic car wash and a convenience store.
Therefore, the proposed retail store shall not be located on the said portion of the lands.

Notes: The subject lands are currently subject to Interim Control By-law 15-245. This Interim Control By-law restricts a land owner from replacing any building on a lot, from building on a vacant lot, or from increasing the existing building size by more than 10%. Please be advised that this By-law will be in place from October 28, 2015 to October 28, 2016, with the potential of extending it for another year. Please note, unit #2, #6 and #7 as shown on the submitted plans have not been considered separate dwellings units as confirmed by the applicant. Therefore, these shall remain as common amenity/storage areas; otherwise, additional variances shall be required.
