2.
A further variance will be required if any portion of the dwelling provides a ceiling height
in excess of 4.6 metres.
3. A further variance will be required if a basement, defined as having more than one-half of its clear height above grade, is provided and not a cellar, defined as having more than onehalf of its clear height below grade.

No onsite manoeuvring aisle width shall be provided for the two (2) parallel parking spaces instead of the minimum 3.7m wide manoeuvring aisle width required on site; 7. A minimum parking space size of 2.6m x 5.5m shall be permitted instead of the minimum 2.7x 6.0m size required for perpendicular parking spaces and the minimum 6.7m
length required for parallel parking spaces; 8.
No loading space shall be provided instead of the minimum one (1) loading space
required;
9. Required parking in a residential district shall be permitted to be located in the required front yard whereas the By-law does not permit required parking in a residential district to be located in the required front yard; 10. The access driveway shall be permitted to be located as close as 0.0m from the common boundary of a district that does not permit a multiple dwelling;
11. residential Vehicular access the parking for the multiple dwelling shall be no permitted "D" district to lands (public spaces alley) whereas the By-law states that land in in a residential district in which is multiple dwelling is not permitted shall be used for vehicular access to or egress from any land usedfor a multiple dwelling; and,
12. No paving with concrete or asphalt or combination of concrete and asphalt shall be provided for the four parking spaces and associated manoeuvring and access driveway
whereas the zoning By-law states that a permanent durable and dustless surface that is .../2
HM/A-16:195 Page 2 paved with concrete or asphalt of a combination thereof shall be provided for every parking area, manoeuvring and access driveway.
Notes: The zoning By-law permits a fire escape to encroach into a required side yard not more {han one-third of its.width of 1.0m whichever is the lesser. Therefore, based on the minimum required 1.2m side yard, a fire escape Shall maintain a minimum setback of 0.8m to the northerly side lot line. Insufficient information was provided to confirm complianceÿ Eaves and gutters may project into a side yard not more than one-half of its width or 1.0m whichever is the lesser. Therefore, the eave and gutter shall maintain a minimum setback of 0.6m to the northerly side lot line. No details were provided to confirm compliance.
The front yard variance is only an approximation and shall be verified by the applicant. Additional lands owned by the applicant known as 13 Springer Avenue are subject to a successful rezoning and site plan control application and have not been included as part of this application. Our records show that the recognized use for the building located at the rear of the lot is a legally established non-conforming storage Warehouse for a contractor's yard.
It is assumed that the four (4) parking spaces shown on the subject lands have been allocated to the proposed multiple dwelling. '1
Please note that there are no minimum lot area or lot width requirements for a multiple dwelling in "D" district.

provided and maintained along every side lot line and rear lot line of a public parking lot which

A landscaped area having a minimum average width of 2.0m, but not less than 1.0m in
width, shall be provided along a 7.8m portion of the Upper James Street street line extending northerly from the corner of Upper James Street and McEIroy Road West and a landscaped area having a minimum average width of 2.0m, but not less than 1.0m in width, shall be
provided along a 15.0m portion of the McElroy Road West street line extending westerly from the corner of Upper James Street and McEIroy Road West instead of the requirement that where any parking space or manoeuvring space is adjacent to a street line, a landscaped area having a minimum average width of 2.0m, but not less than 1.0m in width, shall be provided and maintained along the entire street line of the lot, except for the area used for access driveways; 4. A bell telephone box shall be permitted in a landscaped area instead of the requirement that a landscaped area shall be fully and completely open and exposed to natural light and air and unobstructed above the surface; 5.
A minimum parallel parking space size of 2.4m wide x 6.0m long shall be provided
instead of the minimum required size of 2.5m wide x 6.7m long;
6. A 2.7m aisle width manoeuvring space shall be provided for the two (2) parking spaces in the front yard instead of the minimum required aisle width manoeuvring space of 6.0m for a 900 parking angle; 7. A 3.5m aisle width manoeuvring space shall be provided for the two (2) parallel parking spaces in the rear yard instead of the minimum required aisle width manoeuvring space of

On-site manoeuvring shall not be provided for four (4) parking spaces and shall be
provided on the abutting lands to the north (690 Upper James Street) instead of the requirement that the required manoeuvring space shall be provided and maintained only on

Bumpers or wheel barriers shall not be provided for the parallel parking spaces instead of the requirement that bumpers or wheel barriers to prevent physical encroachment beyond the parking area except at the entrance to and exit from the parking area; and, 10. Interlocking brick shall also be permitted for the surface of the parking area, manoeuvring space, and access driveways at the front (east side) of the building instead of the requirement that a permanent durable and dustless surface that is graded, drained, and paved with concrete or asphalt or a combination of concrete and asphalt shall be provided and maintained for every parking area, manoeuvring space and access driveway.
