A maximum ground floor area of 107.0m2 shall be permitted instead of the maximum
40.0m2 ground floor area permitted; and,
5. A maximum lot coverage of 107.0m2 shall be permitted instead of the maximum 90.0m2 lot coverage permitted for accessory buildings.
Notes: The applicant shall confirm that the height dimension of the accessory building (private garage) has been determined as defined in the Zoning By-law in order to ensure that the requested height variance is correct. Otherwise, additional variances may be required. The Zoning By-law permits a maximum tot coverage of 35.0% insufficient details were provided to confirm compliance.
Eaves or gutter may be permitted to project a maximum of 30.0cm into a required minimum setback area. No details were provided to confirm compliance. Please note that the floor of the private garage shall be a minimum of 30.0cm above the centre line of the street adjacent to the garage. No details were provided to determine compliance. All new fencing proposed shall be in compliance with the regulations contained within the Fence By-law 10-142.

The 6.0 m wide private condominium road shall be considered a street notwithstanding the provision of the By-Law that states that a street shall mean a public Highway or road allowance having a minimum width of 12.0 m; 16. Visitor parking required for the semi-detached dwellings shall be permitted within the common element lands instead of the being provided on the lot on which the use is located; 17. Zero meters separation from the street shall be provided for the visitors parking instead of the minimum required 3.0 m separation from the street; 18. Zero meters separation from the street shall be provided for the parking spaces to be located within the driveways instead of the minimum required distance of 5.8 m from the street line; and 19.
No barrier free parking spaces shall be provided on site instead of the minimum required

its required width (being 0.2m); 7. A minimum of 35% of the front yard shall be used for a landscaped area instead of the requirement that not less than 50% of the gross area of the front yard shall be used for a landscaped area excluding concrete, asphalt, gravel, pavers, or other similar materials; 8. No on-site manoeuvring space shall be provided instead of the requirement that the manoeuvring space shall be provided and maintained only on the lot on which the principle use, building or structure is located;

COMMITTEE OF ADJUSTMENT NOTICE OF PUBLIC HEARING
APPLICATION FOR MINOR VARIANCE APPLICATION NO. HM/A-16:27 IN THE MATTER OF The Planning Act, R.S.O., 1990, c.P. 13, as amended and of the Zoning By-Law No. 6593, of the City of Hamilton, Sections 14 and 19. AND IN THE MATTER OF the Premises known as Municipal number 1285 Main Street East in the City of Hamilton and in an "H" (Community Shopping and Commercial, etc.) district;
AND IN THE MATTER OF AN APPLICATION by the agent Michael Sabelli on behalf of the owner Omar khan, for relief from the provisions of the Zoning By-Law No. 6593, under Section 45 of The Planning Act, R.S.O. 1990, c. P. 13, so as to permit the conversion of
the existing building, which presently contains one (1) commercial unit and one (1)
dwelling unit, by adding one (1) additional dwelling unit for a total of 2 dwelling units notwithstanding that the lot containing the building to be converted is 114.0m from the closest lot (being 1266 Main Street East) which was previously converted under the requirements of Section t9 of Hamilton Zoning By-law 6593 instead of being a minimum distance of 180m from another building converted under the requirements of Section 19. TAKE NOTICE that this application will be heard by the Committee as shown below:
