A maximum building setback o f 75.6m from the street shall be provided fo r the proposed addition instead of the maximum permitted building setback o f 25.0m; and, 4. A landscaped area o f 2.5m shall be provided abutting a street (except for points of ingress and egress) instead o f the minimum required 6.0m landscaped area. NOTES: 1. The proposed addition appears to be straddling a P5 and M3 Zone boundary. Therefore, each such portion of the lot shall be used in accordance with the provisions for each of the applicable zones. 2. Variances have been written exactly as requested by the applicant. Insufficient information has been provided with respect to the proposed addition to determine if additional parking will be required. Furthermore, no details have been provided with respect to the existing parking area to determine zoning compliance. It should be noted that parking fo r a motor vehicle service station use requires parking to be provided at a rate o f four (4) parking spaces fo r each service bay. If parking compliance cannot be achieved in accordance with Section 5 o f Hamilton Zoning By-law, further variances would be required.

The zoning By-law requires a minimum of one (1) parking space fo r each 30.0m2 o f gross floor area which accommodates the office com ponent of the kennel. Based on the submitted plan, six (6) parking spaces are provided; however, the gross floor area for the office com ponent was not submitted in order to determine the minimum num ber of parking spaces required. An eave or gutter may project a maximum of 0.6m into any required yard. No details were provided to confirm compliance. The lands are located within or adjacent to an Environmentally Sensitive Area (ESA) and are subject to Site Plan Control.
