No onsite manoeuvring shall be provided for the parking spaces instead of the minimum requirement that a manoeuvring space abutting and accessory to each required parking space shall be provided and maintained on the lot;
4.
The accessibility to the parking spaces shall be permitted to be obstructed by another vehicle whereas the By-law requires an unobstructed access driveway to the parking space;
5.
The gross area of the front yard shall be permitted to contain a landscaped area of 46.0% instead of the minimum 50.0% landscaped area required; and,
6.
The parking area shall be permitted to occupy 54.0% of the gross area of the front yard instead of the maximum 50.0% permitted.
Notes: The variance to the gross floor area ratio is written as requested. The applicant shall ensure that the Gross Floor Areas have been determined in accordance with the Zoning By-law. The existing floor area ratio for this property is 0.66. This application proposes to increase the floor area by a ratio of 0.13. A minimum of three (3) parking spaces are required for the single family dwelling based on a total of nine (9) habitable rooms. Variance #5 and #6, were requested by the applicant in the previous submission.

GENERAL NOTES 1)
Where possible lots shall be designed with a minimum apron of 1,5 m. sloping away from the house with a minimum of 0.15 m. elevation differential.
2) All yards shall be designed with 2.0 % to 5.0 % grade. All slopes to be 3:1 maximum. 3) Swales shall be designed with a minimum grade of 2.0 %. 4) All roof leaders shall discharge to the ground onto splash pads and shall not be connected to the storm sewer and shall discharge to swale conveying surface drainage toward street line. A combined maximum area of 54.0m2 shall be permitted for the roof top mechanical penthouses instead of the maximum 30.0m2 area permitted; 4. A maximum of fifty-one (51) units shall be permitted instead of the maximum fortyeight (48) units permitted; 5. The projection of balconies (Juliette style) shall be permitted into the northerly side yard located adjacent to the P5 zone, whereas the By-law does not permit any projections into the northerly side located adjacent to the P5 zone; and, 6. A minimum of fifty-four (54) parking spaces shall be permitted instead of the seventy-seven (77) parking spaces required. Notes: These variances are necessary to facilitate Site Plan Control Application SPA-17-
020. The by-law permits a maximum height of 11.4m; however, no elevation plans were provided to confirm compliance. Therefore, further variances may be required. The applicant requested a variance to permit a landscaping of 33.0% for the total property exclusive of the P5 area; however, a variance is not required as the by-law requires a minimum of 30.0% of the site area (exclusive of the P5 zone) to be provided as landscaped area. The applicant requested a variance to permit no rear yard landscaping; however, this variance is not required as there is no rear yard landscaping requirement. The applicant has requested for a variance to permit a minimum landscaped area of 63% of the total front yard. However the requested variance is not required as the by-law ...12
DN/A-17:76 Page 2 requires a minimum of 50.0% of the front yard of residential buildings to be provided as landscaped area. The applicant requested a variance to permit an additional thirty-two (32) parking spaces and loading on the adjacent property known as 363 Park Street West. However, the said requested variances cannot be granted through this application for the adjacent lot. In addition, please note that the adjacent lands are zoned I.L. (Light Industrial) which requires a successful rezoning application in order to permit an apartment building and any associated uses (i.e. parking, loading etc.). Therefore, the parking spaces and loading located on said adjacent lands shall not be used to accommodate additional parking or loading for the proposed apartment building until such time that a successful rezoning application is completed. The by-law requires a minimum of thirteen (13) parking spaces to be designated exclusively for visitor parking. Based on the plans provided, no visitor parking appears to have been exclusively designated. Therefore, further variances may be required. The By-law requires a permanent, durable and dustless surface that is graded and drained and paved with concrete, asphalt or similar material. Insufficient information was provided in order to confirm compliance. The applicant requested a variance to permit no on-site loading; however, this variance is not required as there is no minimum requirement for loading to be provided on site.
