An easterly side yard of 1.2m shall be provided for the proposed accessory structure (three car garage) instead of the minimum required 3.0m setback for accessory structures have a floor area greater than 18.0m; and, 8. P. 13, so as to permit the construction of a four storey apartment building consisting of fifty-one (51) dwelling units as per Site Plan Application DA-13-024, notwithstanding that; 1. A minimum westerly side yard of 1.2m shall be permitted from the side lot line measuring 1.524m instead of the minimum 5.1m side yard required; 2. A minimum rear yard of 1.2m shall be permitted instead of the minimum 3.9m rear yard required from the lot line measuring 25.61m and the minimum 5.3m rear yard required from the lot line measuring 32.34m; 3. A maximum of fifty-one (51) units shall be permitted instead of the maximum forty-eight (48) units permitted; 4. The projection of balconies (Juliette style) shall be permitted into the northerly side yard within the RM3/S-122 portion of the lands only and not including the P5 zone whereas the By-law does not permit any projections into the northerly side yard located adjacent to the P5 Zone; 5. Balconies shall be permitted to be located as close as 0.6m to the front lot line instead of the minimum 1.6m setback required; 6. The projection of sills, decorative windows, door trims, fascia, cornices, dentils, soffits eaves, gutters and other similar features shall be permitted to be located as close as 1.0m to the front lot line instead of the minimum 1.6m setback required; and, 7. The portion of the building containing the parking levels (main floor and underground floor) shall be permitted to be located as close as 1.2m from the rear lot lines and as close as 1.2m from the westerly side lot line measuring 1.524m instead of the minimum 5.3m required from the rear lot line measuring 32.34m, the minimum 3.9m setback required from the rear lot line measuring 25.61m and the minimum 5.1m setback required from the westerly side lot line measuring 1.524m.

A minimum lot width of 9.7m shall be permitted for both the severed and the retained lands instead of the minimum 12.0m lot width required. Notes: i) No floor plans were provided to confirm the total number of habitable rooms. Therefore, the requested variance could not be confirmed. ii) No elevation plans were provided to confirm the maximum proposed height. Therefore, further variances may be required. iii) The finished level of the garage floor shall be a minimum of 0.3m above grade. The loading door accessed from Bowen Street shall not be screened from view instead of providing a Visual Barrier to screen the loading door from view from the street; and, 9. A total of 69 on-site parking spaces shall be provided instead of a minimum of 173 parking spaces required for a multiple dwelling consisting of 167 dwelling units greater than 50 square metres in gross floor area and 17 dwelling units 50 square metres or less in gross floor area.

AND IN THE MATTER OF the Premises known as Municipal number 10 Mayflower Avenue in the City of Hamilton and in a "D" (Urban Protected Residential - One and Two Family Dwellings) district; AND IN THE MATTER OF AN APPLICATION by the agent Greg Callaghan on behalf of the owner Robert Atkinson, for relief from the provisions of the Zoning By-Law No. 6593, under Section 45 of The Planning Act, R.S.O. 1990, c. P. 13, so as to permit the construction of a second storey addition to the existing one storey single family dwelling notwithstanding that; 1. A minimum front yard depth of 0.3 m shall be provided instead of the minimum required 6.0 m; 2. A minimum side yard width of 0.1 m shall be provided on the easterly side lot line instead of the minimum required side yard width of 0.9 m; 3. A minimum rear yard depth of 0.6 m shall be provided instead of the minimum required 3.0 m rear yard depth for a lot of record; 4. One (1) parking space shall be provided on site instead of the minimum required two (2); 5. A setback of 0.0 m shall be permitted on the northerly lot line for the eaves and gutters instead of the maximum 1.5 m provided that no such projection shall be closer to a street line than 1.5 m; 6. A setback of 0.0 m shall be permitted on the easterly side lot line for the eaves and gutters instead of the minimum required 0.05 m; and 7. A setback of 0.0 m shall be permitted on the southerly lot line for the eaves and gutters whereas the By-Law requires a maximum 1.5 m into a required rear yard. Notes: An Encroachment Agreement with the Roads Department may be required for the eaves and gutters shown to encroach on the Road Allowance.
