SUBJECT Amendments to the Future Land Use Plan and Zoning Maps for 0 Wilson Road (Wake County PIN 0754796300) Located in the Vicinity of Fairbanks Road and Flip Trail. - Eliot Ward, Planner I - Public Comment Session: October 12th - Recommendation: October 12th Recommendation: The Planning and Zoning Board is asked to make a recommendation to the Town Council on the following items in the following order: 1. Resolution 2017-299-0-A of the Morrisville Town Council Pertaining to the Amendment of the Future Land Use Plan for Property Commonly Known as 0 Wilson Road and Located in the Vicinity of Fairbanks Road and Flip Trail (LUP 17-01). 2. Resolution 2017-299-0-B of the Morrisville Town Council Pertaining to the Adoption of the Plan Consistency Review Statement for a Proposed Zoning Map Amendment for Property Commonly Known as 0 Wilson Road and Located in the Vicinity of Fairbanks Road and Flip Trail (REZ 17-02). If recommending approval the following statement must be provided as part of the motion: "The requested Zoning Map Amendment will rezone the subject property to the Low Density Residential (LDR) district and is consistent with the Comprehensive Plan because: A. The Town of Morrisville Land Use Plan, as recently amended, recommends Low Density Residential (LDR) district zoning of the property and Low Density Residential (LDR) district zoning is proposed. B. The requested zoning map amendment will promote growth and development that contributes to and builds upon the Town’s overall image as a well-planned, attractive, livable, and unique community in the Triangle Region, as recommended by Policy 1A in the 2009 Land Use Plan. C. The requested zoning map amendment is consistent with Policy 1E of the 2009 Land Use Plan as it will promote detached residential land uses outside activity centers and in context with surrounding uses. As a result, this zoning map amendment is consistent with the Town of Morrisville’s adopted plans. In addition, the requested zoning map amendment is compatible with existing and proposed uses surrounding the subject property and will result in a logical and orderly development pattern and is therefore, reasonable and in the public interest."
3. Ordinance 2017-299-0 of the Morrisville Town Council Approving a Zoning Map Amendment for Property Commonly Known as 0 Wilson Road and Located in the Vicinity of Fairbanks Road and Flip Trail to the Low Density Residential District (REZ 17-02). In accordance with amended General Statute 160A-383, approval of a zoning map amendment will now also amend the coinciding land use plan. However, a statement must still be presented describing how the zoning amendment is consistent with the land use plan, as well as why the proposed action is reasonable and in the public interest. Due to the new amendment, Town staff has chosen to combine the land use amendment and zoning amendment into a single briefing item. Updates/History of Briefing: Not Applicable Executive Summary and Background Information: The following land use plan amendment and rezoning applications are in relation to approximately 0.7 acres of property commonly known as 0 Wilson Road (Wake County PIN 0754796300) and located in the vicinity of Fairbanks Road and Flip Trail (see ATTH 01 – Location and Zoning Map; ATTH 02 – Aerial Map). Terry and Michelle Wells, owners of the subject property, are requesting an amendment to the future land use plan to identify the property for future Low Density Residential (LDR) use (see ATTH 03 – Future Land Use Map). Mr. and Mrs. Wells are also requesting approval of a general zoning map amendment to have the subject property rezoned to the Low Density Residential (LDR) district. The subject property will be known as 1729 Fairbanks Road in the future. The petitioners are making the requests in order to accommodate the construction of a new, detached single-family residence on the property. However, as the request is a general rezoning request, if approved, any use permitted in the LDR district would be permitted to be constructed on the property provided all other Code requirements are met. All of the permitted uses for the Low Density Residential (LDR) district can be found in Table 4.2.4 of the UDO (see ATTH 04 – LDR Permitted Uses). The subject property is currently within the Town of Cary’s extraterritorial jurisdiction (ETJ); however, it is not currently adjacent to Cary’s borders and is adjacent to Morrisville’s borders. Therefore, with the Town of Cary’s consent, the property is proposed to be annexed to Morrisville in accordance with NCGS 160A-58.1 which prohibits satellite annexations when the annexation is closer to the primary corporate limits of another city. The property owner is making this request in order to allow the site to be served by utilities. For the Planning and Zoning Board’s information, a copy of a letter from the Town of Cary consenting to annexation is attached (see ATTH 05 – Cary Consent Letter). The Morrisville Town Council will consider the annexation. No action or recommendation on the annexation is needed from the Planning and Zoning Board. The existing Town of Cary R-20 zoning district is primarily a detached residential district focused on half-acre lots (see ATTH 06 – Cary Permitted Uses). Cary’s R-20 zoning district permits a maximum density of 2.17 units per acre on lots with a minimum area of 20,000 sf and minimum lot width of 90' (see ATTH 07 – Cary Dimensional Standards). In comparison, the Morrisville LDR district allows a maximum density of 4.5 units per acre on lots with a minimum area of 8,000 sf and minimum width of 60' (see ATTH 08 – Morrisville LDR Standards). The Morrisville Town Council is tentatively scheduled to consider the annexation, land use plan amendment and zoning map amendment requests at meetings on November 14, 2017; November 28, 2017; and December 12, 2017.
Potential Options: The Planning and Zoning Board should hold public comments sessions on the proposed land use plan amendment and zoning map amendment and make recommendations on the requests to the Town Council. The Board may either: 1. 2.
Recommend Approval of the Requests; or Recommend Denial of the Requests.
A land use map amendment and a zoning map amendment are both legislative actions and are generally considered to be discretionary. However, in reviewing the requests, the Board should consider how the requests comply with the items set forth in Sections 2.4.3 and 2.4.19 of the Administrative Manual (see ATTH 09 – Comprehensive Plan Amendment Standards and ATTH 10 – Rezoning Map Amendment Standards).
Staff Recommendation: Town staff recommends approval of the land use plan amendment request and zoning map amendment request based upon the following: • The zoning and land use amendments are consistent with the stated purpose of the Low Density Residential (LDR) zoning district outlined in Section 3.3.3 of the Town of Morrisville UDO (see ATTH 08 – Morrisville LDR Standards); •
The subject property is adjacent to a Low Density Residential (LDR) district on the western border; and
• With a lot area of approximately 30,500 sf, the subject property does not meet the minimum requirement of 40,000 sf for a Very Low Density Residential (VLDR) zoning district; and • The subject property is adjacent to single-family detached homes on all sides, and in trying to maintain the character of the surrounding area, the Low Density Residential (LDR) zoning district will not permit the use of attached single-family homes, whereas the Medium Density Residential (MDR) zoning district does. Therefore, the proposed zoning and land use amendment is consistent with the uses in the surrounding area and would result in a logical and orderly development pattern.
