APPLICATION NO. HM/A-17:334 IN THE MATTER OF The Planning Act, R.S.O., 1990, c.P. 13, as amended and of the Zoning By-Law No. 05-200, of the City of Hamilton, Sections 5 and 6.2. AND IN THE MATTER OF the Premises known as Municipal number 11-15 Cannon St. W., in the City of Hamilton and in a "D2, 3T" (Towntown Prime Retail Streets (D2) (Amending By-law 17-082 (not yet final & binding) district; AND IN THE MATTER OF AN APPLICATION by the agent Joe Lakatos on behalf of the owner Areacor Inc. - Property Capital Development, for relief from the provisions of the Zoning By-Law No. 05-200, under Section 45 of The Planning Act, R.S.O. 1990, c. P. 13, so as to permit construction of a six (6) storey building containing ground floor commercial and a forty (40) unit multiple dwelling on the upper storeys in order to facilitate Site Plan Application File No. DA-17-110 notwithstanding that: 1. A maximum of 58% of the fagade of each of the second and third storeys shall be composed of windows instead of the requirement that a maximum of 40% of the fagade of the second and third storeys shall be composed of windows; 2. A minimum of 0.3 of a parking space shall be provided for each dwelling unit of the multiple dwelling instead of the requirement that 1 parking space for each dwelling unit, except where a dwelling unit is 50m2 in gross floor area or less, in which case, parking shall be provided at a rate of 0.3 spaces for each such unit; and, 3. No maximum parking space length shall be required instead of the maximum permitted parking space length of 6.0m. NOTE: i.
The variances are necessary to facilitate Site Plan Application File No. DA-17-110.
ii. Amending By-law 17-082 is not final as it has been appealed to the Ontario Municipal Board. iii. If Variance # 2 is granted, twelve (12) parking spaces shall be required and have been provided for the forty (40) unit multiple dwelling. Based on the existing regulations, a total of twenty-six (26) parking spaces are required as the multiple dwelling is intended to contain 20 dwelling units which are 50m2 or less in gross floor area and 20 dwelling units which are over 50m2 in gross floor area. The commercial unit is intended to contain a retail store which does not require parking. iv. Variance # 3 is intended to allow a length of 6.129m for three (3) of the parking spaces within the underground garage. The present regulations require a maximum parking space size of 3.0m wide x 6.0m long. All parking spaces conform to the minimum required size of 2.6m wide x 5.5m long.

The Zoning By-law states that an eave/gutter may project into a side yard a maximum of one-half of its width or 1,0m whichever is the lesser. Therefore, if variance for side yard of 0.2 m is approved then eaves/gutters may project a maximum of 0.1 m to the new 0.2 m side yard width. No details were provided to confirm compliance; as such, further variances may be required. Please ensure that eaves and gutters do not encroach beyond the property line.
