The dwelling and adjacent residence was constructed around 1900 according to Cultural Heritage Planning and is considered non-complying with the “D” District in terms o f m inimum lot area, lot width, side yards, front yard and parking. 3. There was insufficient information provided with respect to eaves and gutter projections into the side and rear yards. Additional variances may be required if these projections do not com ply with requirements o f Zoning By-law No. 6593. 4. Building elevations were not provided with the Com m ittee o f Adjustm ent application to confirm the height o f the proposed addition as being less than 2.5 storeys and 11 metres. If the addition exceeds the height requirements, an additional variance may be required fo r the southerly side yard as the “D” District requires a 2.7 metre side yard.

A minimum m anoeuvring space width o f 2.1 metres shall be provided instead o f providing a manoeuvring space with a m inimum width o f 6.0 metres required to be abutting upon and accessory to each parking space; 7. A m inimum parking space size o f 2.7 metres in width by 5.4 metres in length shall be provided instead o f the minimum required parking space size o f 2.7 metres in width x 6.0 metres in length; Proposed Accessory Building: 8. The accessory structure shall be permitted to be located 0.0 metres from the easterly side lot lie instead o f the minimum required setback o f 0.45 metres; and, 9. NOTES: 1.
It appears the existing dwelling provides a basement, defined as having one-half or more o f its clear height above grade, and not a cellar, defined as having more than one-half o f its clear height below grade. A basem ent is considered a storey; as such the existing dwelling is deemed to be 3.5 storeys which is required to provide a minimum side yard width of 2.7 metres.

Notes: i) The building height shown has not been measured from grade as defined. As such, the applicant shall ensure that the requested variance #2 is correct. Ii) Please note that the 120.0m2 area permitted by the Zoning By-law is for all accessory buildings on the lot. Our records indicate that the existing garage is considered a detached structure as it is not attached by roof-over enclosed structure complete with footings. Therefore, the applicant shall ensure that variance #1 is correct. iii) The applicant shall ensure any new proposed access driveway is compliance with Section 5 of the Hamilton Zoning By-law 05-200. iv) Please be advised that a portion of this property is under Conservation Management. Please contact Hamilton Conservation Authority prior to any development. v) Human habitation is prohibited within an accessory building. The proposed storage shall be incidental and associated only with the existing single detached dwelling. Any use or storage not associated with the principle use is not permitted. vi) An Environmental Impact Statement (EIS) may be required for development proposed on lands zoned P7 as well as development proposed within 120.0m of natural features.
